B) That based on the evidence presented at the hearing, the Commission
DETERMINES that the 3380 MADISON STREET ACQUISITION is
consistent with the General Plan and APPROVES PCD/GPC 05-03 based upon
the following:
Findings:
1. This project is consistent with the goals, objectives, policies and implementation
programs of the City’s General Plan in that the property proposed to be acquired is in
close proximity the Pine Avenue Park site and to other parcels in City ownership
and may be developed for park-related uses or some other public purpose. While
the subject parcel is zoned for residential uses, public facilities are allowed in
residentially zoned areas with approval of a Conditional Use Permit.
2. That the Planning Director has determined that the project belongs to a class of projects
that the State Secretary for Resources has found do not have a significant impact on the
environment, and it is therefore categorically exempt from the requirement for the
preparation of environmental documents pursuant to Section 15061(b)(3) of the State
CEQA Guidelines. In making this determination, the Planning Director has found that
the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to
this project.
