HomeMy WebLinkAbout2005-06-01; Planning Commission; Resolution 59131 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 5913 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A PLANNING COMMISSION DETERMINATION OF GENERAL PLAN CONSISTENCY FOR THE CITY ACQUISITION OF PROPERTY LOCATED AT 3380 MADISON STREET IN LOCAL FACILITIES MANAGEMENT ZONE 1. CASE NAME: 3380 MADISON STREET ACQUISITION CASE NO: PCD/GPC 05-03 WHEREAS, City of Carlsbad, “Developer,” has filed a verified application with the City of Carlsbad regarding property owned by Andrew L Ayala, “Owner,” described as Lots 3 & 4 of Block 45 of the Town of Carlsbad, according to Map No. 775, in the City of Carlsbad, County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County, March 12,1915 (“the Property”); and WHEREAS, said verified application constitutes a request for a Planning Commission Determination for General Plan Consistency, on file in the Planning Department 3380 MADISON STREET ACQUISITION - PCD/GPC 05-03, as provided in Section 2.24.065 of the Carlsbad Municipal Code and Section 65402 of the California Government Code; and WHEREAS, the Planning Commission did on the 1st day of June, 2005, consider said request; and WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Planning Commission Determination. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 B) That based on the evidence presented at the hearing, the Commission DETERMINES that the 3380 MADISON STREET ACQUISITION is consistent with the General Plan and APPROVES PCD/GPC 05-03 based upon the following: Findings: 1. This project is consistent with the goals, objectives, policies and implementation programs of the City’s General Plan in that the property proposed to be acquired is in close proximity the Pine Avenue Park site and to other parcels in City ownership and may be developed for park-related uses or some other public purpose. While the subject parcel is zoned for residential uses, public facilities are allowed in residentially zoned areas with approval of a Conditional Use Permit. 2. That the Planning Director has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15061(b)(3) of the State CEQA Guidelines. In making this determination, the Planning Director has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 1st day of June, 2005, by the following vote, to wit: AYES: Chairperson Segall, Commissioners Baker, Cardosa, Dominguez, Heineman, Montgomery and Whitton NOES: ABSENT: rn JEFFRE N.
