HomeMy WebLinkAbout2006-02-01; Planning Commission; Resolution 60221 PLANNING COMMISSION RESOLUTION NO. 6022 2 A RESOLUTION OF THE PLANNING COMMISSION OF THE 3 CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A GENERAL PLAN AMENDMENT TO 4 AMEND THE TERM "DENSITY BONUS PROGRAM" IN THE , GLOSSARY OF THE LAND USE ELEMENT OF THE GENERAL PLAN TO ENSURE THE DEFINITION OF THE 6 TERM IS CONSISTENT WITH STATE LAW. CASE NAME: DENSITY BONUS AMENDMENT 7 CASE NO.: GPA05-14 8 WHEREAS, the City of Carlsbad, "Applicant", has filed a verified application 9 with the City of Carlsbad regarding property described as citywide ("the Property"); and 10 WHEREAS, said verified application constitutes a request for a General Plan 11 Amendment as shown on Exhibit "B," dated February 1, 2006, on file in the Carlsbad Planning 13 Department DENSITY BONUS AMENDMENT GPA 05-14 as provided in Government Code 14 Section 65350 et. seq. and Section 21.52.160 of the Carlsbad Municipal Code; and 15 WHEREAS, the Planning Commission did, on the 1st day of February 2006, hold a duly noticed public hearing as prescribed by law to consider said request; and 17 WHEREAS, at said public hearing, upon hearing and considering all testimony 18 and arguments, if any, of all persons desiring to be heard, said Commission considered all factors 2Q relating to the General Plan Amendment. 21 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 22 Commission of the City of Carlsbad, as follows: 23 A) That the above recitations are true and correct. 24 B) That based on the evidence presented at the public hearing, the Commission 25 RECOMMENDS APPROVAL of DENSITY BONUS AMENDMENT GPA 05-14, based on the following findings and subject to the following conditions:26 y-i Findings: 28 1. The proposed amendment to the term "density bonus program" in the Glossary of the Land Use Element of the General Plan, as shown on Exhibit "B", is in conformance with the Elements of the City's General Plan based on the facts set 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 forth in the staff report dated February 1, 2006, including, but not limited to the following: a. The proposed amendment is necessary to ensure consistency with the definition of "density bonus" in State density bonus law; and b. The proposed amendment will provide consistency between the General Plan and Zoning Ordinance; and c. The proposed amendments will not conflict with any other policy, goal, objective, or program of the General Plan not being amended. A density increase of at least 25% granted pursuant to Sections 65915 through 65917 of the California Government Code, which is over the otherwise maximum allowable residential density of the under the applicable residential land use designation zoning and land use. Open space lands which are constrained or prohibited from development including beaches, lagoons, wetlands, other permanent water bodies, riparian habitats and steep slopes. Under the City's Growth Management Plan, there are 25 zones and a plan for facilities and improvements is required for each zone before development can occur. A comprehensive, citywide program which identifies how the city can preserve the diversity of natural habitats and protect rare and unique biological resources. See Local Coastal Program. See Local Facilities Management Plan. A specifically prepared land use plan for the portion of the city located within the Coastal boundaries as defined by the State Coastal Act. The plan must address the protection of coastal resources and public access to the coastline.
