20 WHEREAS, a Mitigated Negative Declaration was prepared in conjunction with
21 said project; and
22 WHEREAS, the Planning Commission did on the 16th day of August, 2006, hold
23 a duly noticed public hearing as prescribed by law to consider said request; and

WHEREAS, at said public hearing, upon hearing and considering all testimony
25
and arguments, examining the initial study, analyzing the information submitted by staff, and26
27 considering any written comments received, the Planning Commission considered all factors
28 relating to the Mitigated Negative Declaration.
1 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
2 Commission as follows:

A) That the foregoing recitations are true and correct.

- B) That based on the evidence presented at the public hearing, the Planning
Commission hereby RECOMMENDS ADOPTION of the Mitigated Negative
5 Declaration and Mitigation Monitoring and Reporting Program, according to
Exhibits "NOI" dated May 3, 2006, and "ND," attached hereto and made a part
7 hereof, and "Final Initial Study and Mitigated Negative Declaration for the
City of Carlsbad Fire Station No. 6," dated July 12, 2006," and incorporated
herein by reference and on file in the Planning Department, based on the
following findings and subject to the following condition:

MITIGATED NEGATIVE DECLARATION

PROJECT LOCATION: The project site is located on the west side of recently constructed
Rancho Santa Fe Road, about 0.5 mile south of San Elijo Road. The project site also borders the
east side of former Rancho Santa Fe Road, which has been turned into a public trail.
PROJECT DESCRIPTION: Proposed is an approximately 6,200 square foot, two story fire
station. The station would accommodate up to four employees and two apparatus vehicles. The fire
station would be built on a 0.5 acre city-owned parcel located approximately 300-feet west of
recently constructed Rancho Santa Fe Road. An additional 0.85 acre is needed for accessory
improvements and access to Rancho Santa Fe Road. The entire 1.35 acre project site is largely
disturbed and much of it has been previously graded. The project site is surrounded by open space
preserve, which would be crossed via an existing access and utility easement to provide project
access. A zone change and an amendment to the La Costa Master Plan is proposed for the project.
A minor adjustment to the 1995 City of Carlsbad/Fieldstone/La Costa Associates Habitat
Conservation Plan/On-going Multi-Species Plan for Properties in the Southeast Quadrant of the City
of Carlsbad, California, the document which governs the surrounding open space preserve, is
proposed primarily to allow project access.
PROPOSED DETERMINATION: The City of Carlsbad has conducted an environmental review
of the above described project pursuant to the Guidelines for Implementation of the California
Environmental Quality Act and the Environmental Protection Ordinance of the City of Carlsbad. As
a result of said review, the initial study (EIA Part II) identified potentially significant effects on the
environment, but (1) revisions in the project plans or proposals made by, or agreed to by, the
applicant before the proposed negative declaration and initial study are released for public review
would avoid the effects or mitigate the effects to a point where clearly no significant effect on the
environment would occur, and (2) there is no substantial evidence in light of the whole record before
the City that the project "as revised" may have a significant effect on the environment. Therefore, a
Mitigated Negative Declaration will be recommended for adoption by the City of Carlsbad City
Council.
A copy of the initial study (EIA Part II) documenting reasons to support the proposed Mitigated
Negative Declaration is on file in the Planning Department, 1635 Faraday Avenue, Carlsbad,
California 92008. Comments from the public are invited. Please submit comments in writing to the
Planning Department within 30 days of the date of this notice.
The proposed project and Mitigated Negative Declaration are subject to review and
approval/adoption by the City of Carlsbad Planning Commission and City Council. Additional

DETERMINATION: The City of Carlsbad has conducted an environmental review of the above

review, the initial study (EIA Part 2) identified potentially significant effects on the environment,
and the City of Carlsbad finds as follows:

entire 2.57 acres proposed as temporary impacts; at the
completion of construction, a qualified biologist shall
conduct an impact assessment within the ROW to
document the actual amount of revegetated coastal sage
scrub is impacted, to the satisfaction of the Planning

Mitigation Measure
Prior to issuance of a building or grading permit, whichever
occurs first, permanent impacts to disturbed vegetation
(0.14 acre of impact) and disturbed land (0.70 acre of
impact) shall be mitigated at a 1:1 ratio, totaling 0.84 acre.
This mitigation shall be fulfilled at the City's Lake Calavera
Mitigation Bank, to the satisfaction of the Planning Director.
These impacts shall be mitigated out-of-kind at a 1:1 ratio
because, as stated in the HMP (Table 1 1 , page D-1 13), the
objective is to build the preserve system by combining
small mitigation requirements into a larger, contiguous
area.
Prior to issuance of a building or grading permit, whichever
occurs first, a qualified biologist shall conduct a focused
CAGN survey to determine the presence or absence of the
species within the HCP/OMSP habitat located adjacent to
the project site. If the habitat is not occupied by CAGN,
there are no further grading restrictions.
If habitat within the HCP/OMSP is occupied by CAGN and
construction is proposed to be conducted during the
breeding season of February 15 to July 31, a qualified
biologist shall conduct a pre-construction clearance survey
within one week prior to construction, to determine whether
the CAGN is nesting up to 500 feet of the construction
zone, to the satisfaction of the Planning Director.

Mitigation Measure
An acoustician shall measure ambient noise levels before
construction begins or during a time when construction
activities are not being conducted to the satisfaction of the
Planning Director. If an active California gnatcatcher nest is
located within this area, an acoustician shall measure noise
levels within 1 0 feet of the nest. Noise levels at nests shall
not exceed 61 dB. If noise levels exceed 61 dB, temporary
sound barriers are required or grading shall be restricted in
construction areas near the nest site to reduce noise levels.
Temporary sound barriers shall be placed within the project
footprint and not in the habitat. No noise restrictions are
required for this species outside the nesting season.
Prior to issuance of a building or grading permit, whichever
occurs first, access barriers to protect conserved habitat
shall be built at key entry points. The boundaries of
conserved habitat immediately adjacent to the grading area
shall be flagged by a qualified biologist, and a fence shall
be installed to prevent disturbance by construction vehicles,
to the satisfaction of the Planning Director.

Mitigation Measure
During construction, staging and stockpile areas shall take
place only on the paved portion of old Rancho Santa Fe
Road. Although the paved portion of old Rancho Santa Fe
Road is within a conservation area, this area is an existing
developed area and is also located within various
easements and ROWs. Trash that could attract scavengers
that could prey on sensitive wildlife shall be maintained and
kept to a minimum. Trash containers with animal-resistant
lids shall be provided on the site during construction.
During grading and construction adjacent to conserved
habitat, a qualified biologist shall monitor the adjacent
habitat for dust accumulation, erosion of dirt, or other
disturbances. If disturbance to the conserved habitat is
identified, corrective measures shall be taken immediately.
Prior to issuance of a building or grading permit, the CNLM
shall approve the hydroseed mix proposed for all disturbed
areas including along the access road and old Rancho
Santa Fe Road.
During construction, disturbance of conserved habitat shall
be avoided to the maximum extent possible. Where
disturbance is unavoidable and has been authorized, it
shall be mitigated by restoration of the affected sites.
Revegetation plans shall be prepared for the approval of
the City prior to such disturbances occurring. In addition,
the location and installation of utilities shall be planned
cooperatively with the City, USFWS, and CDFG to minimize
and mitigate the impacts of such projects on species of
concern and conserved habitat. Examples of disturbances

Mitigation Measure
Prior to issuance of a building permit, the engineering
techniques and grading plans shall conform to the
recommendations in Section 6.0 of the geotechnical
investigation (see Appendix C of the Initial Study). The
specific recommendations require that the geotechnical
consultant shall observe onsite excavations and conduct
field density testing of all compacted fill during grading and
construction of the project and conduct laboratory testing
upon completion of the graded pad to determine the actual
expansion potential of finish grade soils.
