HomeMy WebLinkAbout2006-09-06; Planning Commission; Resolution 61721 PLANNING COMMISSION RESOLUTION NO. 6172 2 A RESOLUTION OF THE PLANNING COMMISSION OF THE 3 CITY OF CARLSBAD, CALIFORNIA, APPROVING A PLANNING COMMISSION DETERMINATION OF GENERAL 4 PLAN CONSISTENCY FOR THE CITY DISPOSITION OF 5 PROPERTY AT 4120 SKYLINE ROAD IN LOCAL FACILITIES MANAGEMENT ZONE 1. 6 CASE NAME: DISPOSITION OF 4120 SKYLINE RD CASE NO: PCD/GPC 06-01 7 WHEREAS, City of Carlsbad, "Developer," has filed a verified application with o 9 the City of Carlsbad regarding property owned by Barbara F. Hallman/City of Carlsbad, 10 "Owner," described as Lot 37 of the Carlsbad Highlands No. 2, according to Map 12 No. 2825, in the City of Carlsbad, County of San Diego, State of California, filed in the Office of the County Recorder of San 13 Diego County, December 5, 1951, and a portion of Rancho Agua Hedionda, according to Map No. 823, in the City of 14 Carlsbad, County of San Diego, State of California, filed in the 1<- Office of the County Recorder of San Diego County, November 16,1896 16 ("the Property"); and 17 WHEREAS, said verified application constitutes a request for a Planning18 jg Commission Determination for General Plan consistency on file in the Planning Department, 20 DISPOSITION OF 4120 SKYLINE RD - PCD/GPC 06-01, as provided in Section 2.24.065 of 21 the Carlsbad Municipal Code and Section 65402 of the California Government Code; and 22 WHEREAS, the Planning Commission did on the 6th day of September, 2006, 23 consider said request; and 24 WHEREAS, at said hearing, upon hearing and considering all testimony and 26 arguments, if any, of all persons desiring to be heard, said Commission considered all factors 27 relating to the Planning Commission Determination. 28 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. 2 B) That based on the evidence presented at the hearing, the Commission 3 DETERMINES that the DISPOSITION OF 4120 SKYLINE ROAD is consistent with the General Plan and APPROVES PCD/GPC 06-01 based on the following findings: Findings; 6 1. This project is consistent with the goals, objectives, policies, and implementation programs of the City's General Plan in that the property proposed for disposal is not needed for necessary public infrastructure and the City Council has identified the property as unnecessary to the foreseeable needs of the City. Further, disposition 9 of the property would not preclude the property's use for residential purposes consistent with its General Plan designation. 10 2. That the Planning Director has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15061(b)(3) of the State 13 CEQA Guidelines. In making this determination, the Planning Director has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project.
