HomeMy WebLinkAbout2008-08-06; Planning Commission; Resolution 64431 PLANNING COMMISSION RESOLUTION NO. 6443 2 A RESOLUTION OF THE PLANNING COMMISSION OF THE 3 CITY OF CARLSBAD, CALIFORNIA, APPROVING A PLANNING COMMISSION DETERMINATION OF GENERAL 4 PLAN CONSISTENCY FOR THE CITY ACQUISITION OF 7.54 ACRES OF PROPERTY GENERALLY LOCATED NORTHEAST OF EL CAMINO REAL AND NORTHWEST OF 6 CANNON ROAD WITHIN PORTIONS OF PLANNING AREAS 12 AND 13 OF THE ROBERTSON RANCH MASTER PLAN, IN 7 THE CITY'S NORTHEAST QUADRANT, AND WITHIN LOCAL FACILITIES MANAGEMENT ZONE 14. 8 CASE NAME: ROBERTSON RANCH PARK SITE/FIRE 9 STATION SITE CASE NO: PCD/GPC 08-02 10 WHEREAS, City of Carlsbad, "Developer," has filed a verified application with H the City of Carlsbad regarding property owned by Gary Robertson and Brian Robertson, as , 2 co-successor trustees of the Robertson Family 1995 Trust Dated April 19, 1995 as to an undivided one-half interest; Gary Robertson and Brian Robertson, co-successor trustees 13 under Declaration of Trust dated October 8, 1976, as to an undivided 7% interest; and Gary Robertson and Brian Robertson, co-successor trustees of the Elsie M. Kelly 14 Irrevocable Trust dated June 19,1989 as to an undivided 43% interest, "Owner," described 15 as: 16 That portion of Parcel 2 of Lot Line Adjustment ADJ 01-13 per Certificate of Compliance CE 01-55, Recorded November 17 28, 2001 as File No. 2001-0865065, in the City of Carlsbad, County of San Diego, State of California, more precisely described on the Plat and Legal Descriptions for Purchase j o Area 1 and Purchase Area 2 20 ("the Property"); and 21 WHEREAS, said verified application constitutes a request for a Planning 22 Commission Determination for General Plan Consistency on file in the Planning Department, 23 ROBERTSON RANCH PARK SITE/FIRE STATION SITE - PCD/GPC 08-02, as provided 24 in Section 2.24.065 of the Carlsbad Municipal Code and Section 65402 of the California ^•f 2fi Government Code; and 27 WHEREAS, the Planning Commission did on August 6, 2008, consider said 2° request; and WHEREAS, at said hearing, upon hearing and considering all testimony and 2 arguments, if any, of all persons desiring to be heard, said Commission considered all factors 3 relating to the Planning Commission Determination. 4 5 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 6 Commission as follows: 7 A) That the foregoing recitations are true and correct. o B) That based on the evidence presented at the hearing, the Commission 9 DETERMINES that the ROBERTSON RANCH PARK SITE/FIRE STATION SITE is consistent with the General Plan and APPROVES PCD/GPC 10 08-02 based on the following findings: Findings: 12 1. This project is consistent with the goals, objectives, policies, and implementation 13 programs of the City's General Plan in that the property proposed for acquisition is intended to be used for a public use (i.e. development of a public park and fire 14 station). The subject property includes 5.54 acres (Purchase Area 1) located within 1 <. a portion of Planning Area (PA) 12 that is zoned Planned Community (P-C) with an underlying zone and General Plan Land Use Designation of Open Space (OS), and 16 2.0 acres (Purchase Area 2) located within a portion of PA 13 that is zoned Planned Community (P-C) with an underlying zone of Multi-Family Residential (RD-M) and 17 a General Plan Land Use Designation of Elementary School (E). The Carlsbad Unified School District has declined to purchase PA 13, and therefore, the alternative residential uses allowed by the Master Plan, expansion of the park site, jg or relocation of Fire Station No. 3 may be implemented, subject to a General Plan Amendment to change the General Plan Land Use Designation for PA 13 from E to 20 RM and/or OS. Public facilities are allowed in both the open space zone and residential zone subject to approval of a Conditional Use Permit. 21 2. That the Planning Director has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the 23 environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15061(b)(3) of the State 24 CEQA Guidelines. In making this determination, the Planning Director has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. 26 Conditions: 27 1. A General Plan Amendment shall be submitted and approved to change the 2% General Plan Land Use Designation from Elementary School (E) to Open Space (OS) for Purchase Area 2 either prior to or concurrently with any discretionary PC RESO NO. 6443 -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 20 21 22 23 24 25 26 27 28 actions required for future development of public park and/or fire station facilities on the site. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on August 6, 2008, by the following vote, to wit: AYES: NOES: Commissioners Boddy, Cardosa, Dominguez, Douglas, Montgomery, and Chairperson Whitton ABSENT: Commissioner Baker ABSTAIN: ^NK H.
