HomeMy WebLinkAbout2008-11-19; Planning Commission; Resolution 65121 PLANNING COMMISSION RESOLUTION NO. 6512 2 A RESOLUTION OF THE PLANNING COMMISSION OF THE 3 CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW FOR THE 4 CONSTRUCTION AND OPERATION OF THE CITY'S FIRST 5 RESPONDERS TRAINING FACILITY ON A 4.06-ACRE PARCEL LOCATED AT THE CITY'S SAFETY CENTER BALL 6 FIELD ON ORION WAY, EAST OF EL CAMINO REAL AND NORTH OF FARADAY AVENUE, IN LOCAL FACILITIES 7 MANAGEMENT ZONE 5. CASE NAME: FIRST RESPONDERS TRAINING FACILITY 8 CASE NO.: CUP 08-15 9 WHEREAS, the City of Carlsbad, "Developer'V'Owner," has filed a verified 10 application with the City of Carlsbad regarding property described as 12 AH that portion of Lot "B" of Rancho Agua Hedionda, in the City of Carlsbad, County of San Diego, State of California, 13 according to Map thereof No. 823 filed in the office of the County Recorder of said County November 16, 1896, lying 14 within the land described in deed to said County of San Diego, recorded January 18, 1974, at Instrument No. 74-014190 in said Recorder's Office, described as follows: 16 Commencing at the northeasterly corner of said County of San 17 Diego land; then north 89 degrees 54'00" west, 23.41 feet to point 14 of said Lot "B" as shown on said Map 823; thence along the boundary of said County land, south 54 degrees 19 15'33" west, 326.48 feet; thence south 50 degrees 55'35" west, 1788.65 feet; thence south 01 degrees 28'24" west, 787.30 feet 20 to the true point of beginning; thence continuing along said boundary, south 10 degrees 46'15" west, 1337.68 feet; thence 21 leaving said boundary, south 79 degrees 13'45" east, 703.35 feet; thence north 30 degrees 28'48" east, 900.00 feet; thence north 30 degrees 31'12" west, 800.00 feet; thence south 87 23 degrees 45'29" west, 491.59 feet to the true point of beginning 24 ("the Property"); and 7^ZJ WHEREAS, said verified application constitutes a request for a Conditional Use 9f\ Permit as shown on Exhibits "A" - "BB" dated November 19, 2008, on file in the Planning 27 Department, FIRST RESPONDERS TRAINING FACILITY - CUP 08-15, as provided by 28 Chapter 21.42 and/or 21.50 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on November 19, 2008, hold a duly 2 noticed public hearing as prescribed by law to consider said request; and 3 WHEREAS, at said public hearing, upon hearing and considering all testimony ,- and arguments, if any, of all persons desiring to be heard, said Commission considered all factors 6 relating to the CUP; and 7 WHEREAS, on November 19, 2008, the Planning Commission approved CUP Q 08-15, as described and conditioned in Planning Commission Resolution No. 6512. 9 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 10 Commission of the City of Carlsbad as follows:11 12 A) That the foregoing recitations are true and correct. 13 B) That based on the evidence presented at the public hearing, the Commission APPROVES FIRST RESPONDERS TRAINING FACILITY CUP 08-15, 14 based on the following findings and subject to the following conditions: 15 _,. ,.Findings: 16 The Planning Commission of the City of Carlsbad does hereby find: 17 1. That the requested use is necessary or desirable for the development of the community, and is in harmony with the various elements and objectives of the general plan, including, 19 if applicable, the certified local coastal program, specific plan or master plan, in that the requested use is necessary for the health and safety of the community. The police 20 and fire training facility will provide a facility for specialized training for emergency personnel. The project is in compliance with the General Plan as 2 1 depicted in Table 1 of the staff report. The parcel has a General Plan designation of ~~ Governmental Facilities (G), which designates areas used for major governmental facilities. The site is zoned Open Space (O-S), which allows the construction of 23 public facilities and structures subject to the approval of a Conditional Use Permit (CUP). 24 2. That the requested use is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located in that the requested use is not 25 detrimental to the existing or permitted uses in the zone. The project is a government facility that is not open to the general public. The facility is surrounded 27 by other government facilities such as Fire Station No. 5, the Safety Center and the Public Works fleet maintenance yard.28 PCRESONO. 6512 -2- 3. That the site for the proposed conditional use is adequate in size and shape to 2 accommodate the yards, setbacks, walls, fences, parking, loading facilities, buffer areas, landscaping and other development features prescribed in this code and required by the 3 planning director, planning commission or city council, in order to integrate the use with other uses in the neighborhood, in that the O-S zone contains only one specific development standard: a 25-foot maximum building height unless a higher elevation is approved by a CUP issued by the Planning Commission. Due to the police and fire department's training facility and office/class room needs, all the buildings exceed the 25-foot maximum building height except the Residential Burn Prop which is 24- feet high. The tallest structure is the Commercial Burn Prop tower with a maximum height of 56 feet. The justification for the need to increase the maximum building height of 25-feet is to provide a burn prop structure that reflects realistic situations such as an apartment or office building for training purposes. In addition, the 9 second floor of the shooting range and classroom building provides office space and classrooms that otherwise would not be provided due to the need for the first-floor 10 rooms that support the shooting range (i.e. weapons cleaning area, range control room, etc.). 11 ,2 There are no setback requirements for the OS zone, however, setbacks range from 10 feet to 53 feet. Landscaping is provided in accordance with the City of Carlsbad 13 Landscape Manual. Landscaping will be used around the perimeter of the site to reduce the appearance of bulk and mass of the buildings and to soften the fortress- 14 like appearance of the six-foot high perimeter wall. A total of 42 parking spaces are provided. Parking spaces are already provided at the existing Safety Center (171 spaces), Fire Station No. 5 (30 spaces), Public Work's fleet maintenance yard (164 16 spaces), an overflow dirt lot to the north of the project site (50 spaces), and parking on Orion Way (25+ spaces). Most of the personnel who will be using the Training 17 Facility will walk to the facility from the adjacent Fire Station or the Safety Center and therefore would have already parked at one of the existing parking spaces. 18 ,n 4. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use, in that according to the traffic study prepared by LSA 20 in July 2008, the existing traffic is 958 Average Daily Trips (ADT) and 274 ADT for the project. However, 274 ADT is very conservative. It is difficult to determine exactly the additional ADT for the project since most of the people already driving to the Safety Center or Fire Station No. 5 will also be using the Training Facility and they will walk over to the facility instead of driving to the facility. The Level of 23 Service (LOS) will not be impacted by this project and will stay at a LOS of A during AM and PM peak hours. The street system serving the proposed use is 24 adequate to properly-handle all traffic generated by the proposed use. This facility will have direct access onto Orion Street, which could handle up to 10,000 ADT and 25 Orion Way, which could handle up to 2,000 ADT. 26 That the project is consistent with the adopted Airport Land Use Compatibility Plan for 27 the McClellan-Palomar Airport (ALUCP), dated October 2004, in that the project is consistent with the City's General Plan, therefore the project is consistent with the ALUCP, in that the site is designated Governmental Facilities (G), which designates areas used for major governmental facilities. The site is zoned Open Space (O-S), PCRESONO. 6512 -3- which allows the construction of public facilities and structures subject to the 2 approval of a Conditional Use Permit (CUP). The project also is consistent with the Federal Aviation Regulations (FAR) Part 77 Guidelines, which determines if 3 structures will affect navigable airspace. A Part 77 form was completed for the commercial burn prop building because it was the tallest structure at 56-feet high 4 (tower). The FAA made a Determination of "No Hazard to Air Navigation" 5 (Aeronautical Study No. 2008-AWP-4919-OE dated 8/25/08). Within the Flight Activity Zone areas should be held free of intensive development including uses 6 which involve the assembly of large groups of people (more than 100 in one area). A condition of approval for this project will require the owner to record a Notice of Restriction stating that there will not be an assembly of large groups of people (no more than one hundred (100) persons per assembly area, as defined by the California Building Code Group A Occupancy), and a Hold Harmless Agreement 9 with regard to aircraft operations and noise. This restriction applies to all permitted uses, ancillary uses, and uses allowed by this CUP. 10 Based on the noise/land use compatibility matrix of the ALUCP, the proposed land use is compatible with the airport, in that the project site is outside the 60 dBA CNEL noise contours depicted in the ALUCP. Therefore, noise attenuation and land use compatibility with the airport are not an issue. However, as a condition of 13 approval the Developer shall prepare and record a Notice that the property is subject to overflight, sight and sound of aircraft operating from McClellan-Palomar 14 Airport to the County of San Diego. Therefore, land use compatibility and noise attenuation with the airport are not an issue. Conditions: 17 Note: Unless otherwise specified herein, all conditions shall be satisfied prior to building permit issuance. 18 1. If any of the following conditions fail to occur, or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so 20 implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted; deny or further condition issuance of all 21 future building permits; deny, revoke, or further condition all certificates of occupancy issued under the authority of approvals herein granted; record a notice of violation on the property title; institute and prosecute litigation to compel their compliance with said 23 conditions or seek damages for their violation. No vested rights are gained by Developer or a successor in interest by the City's approval of this Conditional Use Permit. 24 Staff is authorized and directed to make, or require the Developer to make, all corrections and modifications to the Conditional Use Permit documents, as necessary to make them 9, internally consistent and in conformity with the final action on the project. Development shall occur substantially as shown on the approved Exhibits. Any proposed development, 27 different from this approval, shall require an amendment to this approval. 28 3. This approval is granted subject to the adoption of the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program. PCRESONO. 6512 -4- 4. Developer shall comply with all applicable provisions of federal, state, and local laws and 2 regulations in effect at the time of building permit issuance. 3 5. Developer shall submit an interim landscape plan for the landscaping improvements along the east perimeter wall, until construction of the Fire Administration Building. The interim landscape plans shall be Subject to approval by the City t- Landscape Architect. 6 6. Developer shall develop a Parking Management Plan that is reviewed and approved by the Planning Director. The Parking Management Plan shall include the 7 following: o a. First Responders Training Facility manager(s) shall ensure parking is within the 9 facility (rodeo grounds) and are accessible to visiting staff and other non-general public users. Users are to be given direction to use these parking spaces and not 10 to park in the spaces intended for the general public. b. Coordinate large events with the Safety Center - Conference Center events to 12 avoid parking problems. When overflow conditions are anticipated, ensure the First Responders Training Facility users park 1) inside the facility (rodeo 13 grounds) first, 2) use the available parking at Fire Station No. 5, 3) use the available parking at the Safety Center employee lot or 4) park in the Public 14 Works dirt lot. Provide directional signage the day of the event if needed. c. Install "Visitor Parking Only" signs for marking stalls outside the Training 15 Facility perimeter. 17 d. First Responders Training Facility users shall not park in designated Visitor Parking or Skate Park stalls.18 S |o e. First Responders Training Facility manager(s) shall submit to the Planning Director a Parking Monitoring Report at the first anniversary of CUP approval 20 following completion of the shooting range and burn props, and again on the first anniversary following completion of the Fire Administration building. The 21 Parking Monitoring Report shall contain: 22 • Analysis of the actual parking utilization. Identify the peak utilization 23 periods and the percent occupied. 24 • Describe the parking impact actions taken to avoid over-utilization of the parking and the results. 25 • Discuss whether the parking supply is sufficient with or without the parking management, and whether additional measures should be undertaken. 27 • The parking monitoring report will be a requirement of the City's annual CUP review. However, the report is only required following the completion PCRESONO. 6512 -5- of each phase of the project. Annual reports are not necessary unless parking 2 deficiencies are identified. 3 7. This project shall implement and comply with the mitigation measures contained in the Mitigated Negative Declaration processed with the project as contained in ^ Planning Commission Resolution No. 6511 specifically: • Prior to any grading or construction activities, the City Engineer shall review 6 and approve the grading plans for consistency with existing Public Safety and Public Works facilities in the area. 7 „ • Prior to any grading or construction activities, the City Landscape Architect shall review the landscape plans for consistency with the City Landscape 9 Manual and existing Public Safety and Public Works facilities in the area. 1 0 • Prior to issuance of a building permit, a detailed lighting plan shall be reviewed and approved by the Planning Director. The lighting plan shall include specifications indicating that all lighting fixtures have been designed to include 12 shades or hoods, directional lenses, or other techniques to minimize light spillover onto adjacent and nearby properties and reflection into the night sky. 13 Fixtures shall include directional light mounts and non-glare hoods to reduce the potential light and glare impacts on surrounding properties. 14 , r • The project would involve short-term emissions associated with grading and construction. In accordance with Policy C.6 of the City's General Plan, 16 construction control measures in San Diego County's CEQA guidelines, and to ensure compliance with SDAPCD Rules 50 (Visible Emissions) and 51 17 (Nuisance), the following measures listed will apply to the project and will reduce air pollutant emissions associated with project construction activities. Furthermore, certain equipment/vehicles powered by diesel engines would have 19 to meet the applicable Airborne Toxics Control Measures (ATCMs) for control of diesel PM in the exhaust (e.g. ATCMs for Portable Diesel Engines, Heavy-Duty 20 Diesel Trucks Operated by Utilities, Off-Road Diesel Vehicles, and Commercial Diesel Vehicle Idling) that are in effect during the implementation of the project. 22 a. Subject to approval by the City Engineer, the construction contractor shall select the construction equipment used on site based on low emission factors 23 and high energy efficiency. The construction contractor shall ensure that construction grading plans include a statement that all construction 24 equipment will be tuned and maintained in accordance with the manufacturer's specifications. b. Subject to approval by the City Engineer, the construction contractor shall 26 ensure that construction grading plans include a statement that work crews will shut off equipment when not in use. c. Subject to approval by the City Engineer, the construction contractor shall 28 time the construction activities so as not to interfere with peak hour traffic, and to minimize obstruction of through traffic lanes adjacent to the site; if PCRESONO. 6512 -6- necessary, a flagperson shall be retained to maintain safety adjacent to 2 existing roadways. d. Subject to approval by the City Engineer, the construction contractor shall support and encourage ridesharing and transit incentives for the A construction crew. • Subject to approval by the City Landscape Architect, portions of the s construction site to remain inactive longer than a period of three months shall be seeded and watered until the appropriate ground cover is grown in accordance 7 with the Landscape Manual Section IV-E, Slope Revegetation/Erosion Control Policies and Requirements. 8 Q • To minimize construction-related air quality impacts, the construction contractor shall ensure that the following measures are observed: 10 a. AH active portions of the construction site shall be watered a minimum of 11 twice daily, more when needed due to dry or windy conditions, to prevent excessive amounts of dust.12 b. On-site vehicle speed shall be limited to IS mph. c. All on-site roads shall be paved as soon as feasible or watered periodically or j4 chemically stabilized. d. All material excavated or graded shall be sufficiently watered to prevent excessive amounts of dust. Watering, with complete coverage, shall occur at , s least twice daily, preferably in the late morning and after work is done for the day. 1' e. All clearing, grading, earth moving, or excavation activities shall cease . „ during periods of high winds (i.e., greater than 25 mph averaged over one hour). 19 f. All material transported off site shall be either sufficiently watered or securely covered to prevent excessive amounts of dust. g. The area disturbed by clearing, grading, earth moving, or excavation 21 operations shall be minimized at all times. 22 h- Portable engines will be registered under the Statewide Portable Equipment Registration Program (PERP) and will meet applicable emissions 23 requirements. 24 • To reduce the regional air quality impacts, the City Landscape Architect shall 25 determine trees to be planted to provide shade and shadow to buildings. " • To reduce the regional air quality impacts, the additional following features will 27 be implemented as part of the project and subject to review and approval by the Building Official: 28 a. Central water heater for the buildings shall be provided. PCRESONO. 6512 -7- b. Double-paned glass or window treatment for energy conservation shall be 2 used in all exterior windows. 3 c. Energy efficient low-sodium parking lot lights shall be used. If construction must be conducted during the breeding season, a qualified jr biologist shall conduct a focused survey for bird nests not more than 72 hours prior to commencement of vegetation clearing activities. If active nest are found, 6 the City's construction contractor shall cease construction within an appropriate buffer zone of up to 500 feet, as determined by the project biologist, around the nest site until juveniles have fledged and the nesting cycle is complete. Crews will be briefed with the requirements, consequences and enforcement of the Migratory Bird Treaty Act (MBTA) prior to construction activities. 9 Prior to start of grading, the City Engineer shall review and approve a 10 Construction Plan that specifies construction vehicle fueling and maintenance procedures and designates hazardous materials storage areas to preclude the discharge of hazardous materials (e.g., fuels, lubricants, and solvents) used during construction. The Construction Plan shall include specific measures to preclude spills or contain hazardous materials, including proper handling and 13 disposal techniques and the use of impervious liners to prevent soil and water contamination. 14 8. Phasing of the improvements as shown on the project exhibits may be allowed by the Public Works Director in consultation with the Planning Director as necessary. 16 9. Developer/Operator shall and does hereby agree to indemnify, protect, defend, and hold 17 harmless the City of Carlsbad, its Council members, officers, employees, agents, and representatives, from and against any and all liabilities, losses, damages, demands, claims and costs, including court costs and attorney's fees incurred by the City arising, directly or indirectly, from (a) City's approval and issuance of this Conditional Use Permit (CUP 08-15), (b) City's approval or issuance of any permit or action, whether 20 discretionary or nondiscretionary, in connection with the use contemplated herein, and (c) Developer/Operator's installation and operation of the facility permitted hereby, 21 including without limitation, any and all liabilities arising from the emission by the ~~ facility of electromagnetic fields or other energy waves or emissions. This obligation survives until all legal proceedings have been concluded and continues even if the City's 23 approval is not validated. 24 10. Due to the location of the project within the Flight Activity Zone, the following restriction shall apply: 26 a. All assembly areas defined as Group "A" by the 2001 California Building Code are limited to a maximum occupancy of 100 persons. This restriction applies to 27 all permitted uses, ancillary uses, and uses allowed by a Conditional Use Permit. b. Prior to the issuance of building permit, the Developer shall prepare and record a Notice that this property is subject to overflight, sight and sound of aircraft PCRESONO. 6512 -8- operating from McClellan-Palomar Airport, in a form meeting the approval of 2 the Planning Director and the City Attorney (see Noise Form #2 on file in the Planning Department). 3 The Developer shall cause property owner to execute and submit to the Planning Director and City Engineer for recordation a Hold Harmless Agreement <- regarding aircraft operations and aircraft noise prior to issuance of building permit. The form of said agreement shall be reviewed and approved by the City 6 Attorney prior to execution. 7 11. Developer shall submit to Planning Director a reproducible 24" x 36" mylar copy of the Site Plan reflecting the conditions approved by the final decision-making body. o 9 12. Developer shall include, as part of the plans submitted for any permit plancheck, a reduced legible version of all approving resolution(s) in a 24" x 36" blueline drawing 10 format (including any applicable Coastal Commission approvals). * 13. Prior to the issuance of a building permit, the Developer shall provide proof to the Director from the School District that this project has satisfied its obligation to provide school facilities. 13 14. This approval shall become null and void if building permits for Phase I are not 14 issued for this project within 24 months from the date of project approval and building permits for Phase II, or any additional Phases, within 5 years from the date of project approval, unless an extension is granted. 16 15. Building permits will not be issued for this project unless the local agency providing 17 water and sewer services to the project provides written certification to the City that adequate water service and sewer facilities, respectively, are available to the project at the * time of the application for the building permit, and that water and sewer capacity and I o facilities will continue to be available until the time of occupancy. 20 16. Prior to the issuance of the Conditional Use Permit (CUP 08-15), Developer shall submit to the City a Notice of Restriction executed by the owner of the real property to be developed. Said notice is to be filed in the office of the County Recorder, subject to the »- satisfaction of the Planning Director, notifying all interested parties and successors in interest that the City of Carlsbad has issued a Conditional Use Permit by Resolution No. 23 6512 on the property. Said Notice of Restriction shall note the property description, location of the file containing complete project details and all conditions of approval as 24 well as any conditions or restrictions specified for inclusion in the Notice of Restriction. The Planning Director has the authority to execute and record an amendment to the notice which modifies or terminates said notice upon a showing of good cause by the Developer or successor in interest. 27 17. This Conditional Use Permit shall be reviewed by the Planning Director on a yearly basis to determine if all conditions of this permit have been met and that the use does not have a substantial negative effect on surrounding properties or the public health and welfare. If the Planning Director determines that the use has such substantial negative effects, the PCRESONO. 6512 -9- Planning Director shall recommend that the Planning Commission, after providing the 2 permittee the opportunity to be heard, add additional conditions to reduce or eliminate the substantial negative effects. 3 Engineering;4 r 18. Prior to hauling dirt or construction materials to or from the proposed construction site for this project, the City's Contractor shall apply for and obtain approval from the City 6 Engineer for the proposed haul route. 7 19. The City's Engineering Department shall submit a "Notice of Intention" for the start of work to the California State Water Resources Control Board, prior to start of grading.8 9 20. City's Contractor shall comply with the City's Storm water Regulations, latest version, and shall implement best management practices at all times. Best management practices 10 include but are not limited to pollution treatment practices or devices, erosion control to prevent silt runoff during construction, general housekeeping practices, pollution * prevention and educational practices, maintenance procedures, and other management j2 practices or devices to prevent or reduce the discharge of pollutants to stormwater, receiving water or stormwater conveyance system to the maximum extent practicable. 13 21. City's Engineering Department shall complete and submit to the City Engineer a Project 14 Threat Assessment Form (PTAF) pursuant to City Engineering Standards. Concurrent with the PTAF, the Engineering Department shall also submit the appropriate Tier level Storm Water Compliance form and Tier level Storm Water Pollution Prevention Plan 16 (SWPPP) as determined by the completed PTAF all to the satisfaction of the City Engineer. 17 22. City's Engineering Department shall submit a "Storm Water Management Plan 18 (S WMP)." The S WMP shall demonstrate compliance with the City of Carlsbad Standard 19 Urban Stormwater Mitigation Plan (SUSMP), Order R9-2007-0001 issued by the San Diego Region of the California Regional Water Quality Control Board and City of 20 Carlsbad Municipal Code all to the satisfaction of the City Engineer. 21 23. City's Engineering Department shall incorporate Low Impact Development (LID) design techniques, on all final design plans to reduce the amount of run-off by mimicking the natural hydrologic function of the site by preserving natural open-spaces and natural 23 drainage channels, minimizing impervious surfaces, promoting infiltration and evaporation of run-off before run-off leaves the site. City's Engineering Department shall 24 incorporate LID techniques using current County of San Diego Low Impact Development Handbook (Stormwater Management Strategies). LID techniques include, but are not limited to: vegetated swale/strip, rain gardens, and porous pavement, which can greatly 2/- reduce the volume, peak flow rate, velocity and pollutants. 27 24. No structure, fence, wall, tree, shrub, sign, or other object may be placed or permitted to encroach within the area identified as a sight distance corridor as defined by City of 28 Carlsbad Engineering Standards or line-of-sight per Caltrans standards. PCRESONO. 6512 -10- 25. Prior to the start of construction, City's Engineering Department in coordination with its 2 contractor shall submit for the City approval a "Storm Water Pollution Prevention Plan (SWPPP)." The SWPPP shall be in compliance with current requirements and provisions 3 established by the California Regional Water Quality Control Board, San Diego Region, and City of Carlsbad requirements. The SWPPP shall address measures to reduce to the ^ maximum extent practicable storm water pollutant runoff during construction of the c- project. At a minimum, the SWPPP shall: 6 a. include all content as established by the California Regional Water Quality Control Board requirements; and 7 b. include the receipt of "Notice of Intent" issued by the California Regional Water Quality Board; and c. recommend source control and treatment control Best Management Practices (BMPs) 9 that will be implemented with this project to avoid contact or filter said pollutants from storm water to the maximum extent practicable before discharging to City right- 10 of-way or natural drainage courses; and d. establish specific procedures for handling spills and routine clean up. Special 11 procedures for handling clean up and disposal pollutants. 12 Carlsbad Municipal Water District 13 26. The construction of public water and recycled water facilities shall be within public right- 14 of-way or within a minimum 20-foot wide easement(s) granted to the District. 27. Prior to issuance of building permit(s), City's Engineering Department shall pay all fees, 16 deposits, and charges for connection to public water and recycled water facilities.
