A RESOLUTION OF THE PLANNING COMMISSION OF THE
3 CITY OF CARLSBAD, CALIFORNIA, APPROVING A
VARIANCE TO THE SIGN DEVELOPMENT STANDARDS TO
4 ALLOW A 69 SQUARE FOOT LOGO WALL SIGN LOCATED
ADJACENT TO A 41 SQUARE FOOT WALL SIGN, AND
DIRECTIONAL SIGNAGE THAT RANGES IN SIZE FROM 31
6 SQUARE FEET TO 45 SQUARE FEET ON A 159,000 SQUARE
FOOT BUILDING AND TO DENY AN 18 FOOT TALL
7 MONUMENT SIGN LOCATED AT 6020 AVENIDA ENCINAS
IN LOCAL FACILITIES MANAGEMENT ZONE 3.

WHEREAS, Stellar Properties, LLC (Toyota Carlsbad), "Developer and
11
Owner," has filed a verified application with the City of Carlsbad regarding property described
13 as
14 Parcel 2 of Parcel Map No. 1310, in the City of Carlsbad,
County of San Diego, State of California, filed in the Office of
the County Recorder of San Diego County, February 16, 1973,
T , Recorder's file No. 73-042619 of official records16
17 ("the Property"); and
18 WHEREAS, said application constitutes a request to increase the height and
19 area of a monument sign above the maximum allowed, increase the size of one wall sign
20 above the maximum allowed, increase the height of one wall sign above the maximum
21
allowed, reduce the required distance between two wall signs below the minimum
22
separation requirement, and increase the size of three directional signs above the
24 maximum allowed; and
25 WHEREAS, said verified application constitutes a request for a Variance as
26 shown on Exhibits ""A-F" dated December 17, 2008, on file in the Carlsbad Planning
7 Department, TOYOTA CARLSBAD SERVICE CENTER - V 08-03, provided by Chapter
28
21.50 of the Carlsbad Municipal Code; and
1 WHEREAS, the Planning Commission did on December 17, 2008, hold a duly
2 noticed public hearing as prescribed by law to consider said request; and

WHEREAS, at said public hearing, upon hearing and considering all testimony
4
_ and arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to the Variance.
7 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
o0 Commission of the City of Carlsbad as follows:
9 A) That the above recitations are true and correct.

B) That based on the evidence presented at the public hearing, the Planning
Commission APPROVES TOYOTA CARLSBAD SERVICE CENTER - V
08-03, with the exception of the proposed 108 square foot, 18 foot tall
monument sign, based on the following findings and subject to the following
13 conditions:
14 Findings:
15 1. That because of special circumstances applicable to the subject property, including size,
shape, topography, location or surroundings, the strict application of the zoning ordinance
deprives such property of privileges enjoyed by other property in the vicinity and under
17 identical zoning classification, in that the property is zoned Industrial (M), and 1) the
service facility building has limited visibility from Avenida Encinas, which is the
18 location of the primary access, the proposed signs along the western elevation will
only be visible to service facility patrons from onsite, the service building is 159,000
square feet in area and 300 feet in length and the proposed 69 square foot Toyota
logo wall sign and 41 square foot and 31 inch tall Toyota channel letter sign located
21 inches apart is proportionate to the scale of the large building, and 2) there is a
21 480 foot approach to the service writer canopy which requires the directional
signage to be larger in order to alert customers sooner regarding proper direction.

2. That the variance shall not constitute a grant of special privileges inconsistent with the
23 limitations upon other properties in the vicinity and zone in which the subject property is
located and is subject to any conditions necessary to assure compliance with this finding,
in that other buildings hi the M Zone and in the vicinity are clearly visible from the
25 adjoining public rights-of-way, which allows their signage to be entirely visible to
the general public and provide for visual cues regarding onsite direction; and, the
26 Toyota Carlsbad Service Center has a uniquely high volume of patrons using the
site that necessitates clear onsite direction. As the project site and building are not
visible from the public right-of-way due to the site being obscured by an existing
20 building and because of the unusually high volume of customer traffic at the site, the
requested sign variance is justified.

3. That the variance does not authorize a use or activity which is not otherwise expressly
2 authorized by the zone regulation governing the subject property, in that the Variance
request does not affect the intensity or use of the building nor does it authorize a use
.3 not already allowed by the project Conditional Use Permit, Coastal Development
Permit or Site Development Plan.

4. That the variance is consistent with the general purpose and intent of the general plan and
any applicable specific or master plans, in that the increase in height of the channel
6 letter signs, the increase in size of the logo wall sign, and the reduction in separation
between wall signs does not compromise the general aesthetic character of the
7 surrounding area since the building is over 150,000 square feet in area and 300 feet
in length, and the signage is proportionate to the building size, the pairing of the
8 larger logo and letter signs for Toyota is common and used worldwide, the proposed
„ wall signs will not be visible from the Avenida Encinas right-of-way, and the
increase in directional signage size will contribute to a more orderly onsite traffic
10 flow.
11 5. In addition, in the coastal zone, that the variance is consistent with and implements the
requirements of the certified local coastal program and that the variance does not reduce
or in any manner adversely affect the protection of coastal resources as specified in the
-,., zones included in this title, and that the variance implements the purposes of zones
adopted to implement the local coastal program land use plan, in that the proposed
14 signage does have any impact on coastal resources. (Ord. NS-675 § 46, 2003: Ord.

6. The request to erect a 108 square foot and 18 foot tall monument sign at the project
entrance on Avenida Encinas would be granting a special privilege denied to other
j 7 property owners in that there are not unusual circumstances related to the location
of the proposed monument sign that necessitates that the sign must be larger than
18 prescribed for all property owners along Avenida Encinas and the request is
therefore denied and is not approved as part of Variance V 08-03.

20 Conditions:
21 1. Signs proposed for this development shall be in conformance with the approved
Exhibits "A"-"F" as modified to remove the proposed monument sign dated
22 December 17, 2008 and shall require review and approval of a sign permit by the
Planning Director and issuance of a building permit prior to installation of such
3 signs.

Please take NOTICE that approval of your project includes the "imposition" of fees,
dedications, reservations, or other exactions hereafter collectively referred to for convenience as
27 "fees/exactions."
28 You have 90 days from date of final approval to protest imposition of these fees/exactions. If
you protest them, you must follow the protest procedure set forth in Government Code Section
66020(a), and file the protest and any other required information with the City Manager for

processing in accordance with Carlsbad Municipal Code Section 3.32.030. Failure to timely
follow that procedure will bar any subsequent legal action to attack, review, set aside, void, or
annul their imposition.
You are hereby FURTHER NOTIFIED that your right to protest the specified fees/exactions
DOES NOT APPLY to water and sewer connection fees and capacity charges, nor
zoning, grading, or other similar application processing or service fees in connection
planning,
with this
project; NOR DOES IT APPLY to any fees/exactions of which you have previously been given a
NOTICE similar to this, or as to which the statute of limitations has previously
expired.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the
Commission of the City of Carlsbad, California, held on December 17, 2008, by the
vote, to wit:
