A RESOLUTION OF THE PLANNING COMMISSION OF THE
3 CITY OF CARLSBAD, CALIFORNIA, DETERMINING THAT
THE FY 2009-2010 CAPITAL IMPROVEMENT PROGRAM
4 BUDGET IS CONSISTENT WITH THE GENERAL PLAN ON
5 PROPERTY GENERALLY LOCATED CITYWIDE.

WHEREAS, the city of Carlsbad, "Developer," has filed a verified applicationo
9 with the City of Carlsbad regarding property owned by various owners, "Owner," described as
10 Citywide
11 ("the Property"); and
12 WHEREAS, said verified application constitutes a request for a Planning
13
Commission Determination of General Plan Consistency pursuant to Sections 65401 and
14
1, 65402 of the California Government Code, on file in the Planning Department as CAPITAL
16 IMPROVEMENT PROGRAM BUDGET 2009-2010 - PCD/GPC 09-01; and
17 WHEREAS, the Planning Commission did on April 15, 2009, consider said
18 request; and

WHEREAS, at said hearing, upon hearing and considering all testimony and
20
arguments, if any, of all persons desiring to be heard, said Commission considered all factors
~~ relating to the Planning Commission Determination; and
23 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
24 Commission as follows:
25 A) That the foregoing recitations are true and correct.

B) That based on the evidence presented at the hearing, the Commission
27 DETERMINES that CAPITAL IMPROVEMENT PROGRAM BUDGET
2009-2010 - PCD/GPC 09-01 is consistent with the General Plan and
28 APPROVES PCD/GPC 09-01 based on the following findings:

1. The project is consistent with the goals, objectives, and policies of the City's General
3 Plan in that the project requires and ensures the provision of adequate public
facilities and services concurrent with or prior to need.
2. The project is consistent with the Land Use, Circulation, and Public Safety Elements
of the General Plan in that the project implements the Land Use Element goal
requiring that public facilities be adequate to serve the projected population of the
City.
3. As required by the General Plan, the proposed improvements are consistent with
the City's Growth Management Plan in that the project ensures that the necessary
improvements are provided for parks, drainage, sewer, water distribution, traffic
signals, streets, and miscellaneous projects in accordance with the performance
standards contained in the City's Growth Management regulations.
11 4. That the projects listed as "exempt" in Exhibit "A" have been found by the
Planning Director to be exempt with the meaning of CEQA, and a Notice of
12 Exemption will be filed by the Planning Director for those projects where
categorical or statutory exemptions are applicable upon final approval of those
projects as part of the FY 2009-2010 CIP Budget.
14 5. That the projects listed as "requiring CEQA review" in Exhibit "A" will not be
15 implemented until all required CEQA actions have been completed.
