HomeMy WebLinkAbout2009-06-03; Planning Commission; Resolution 65631 PLANNING COMMISSION RESOLUTION NO. 6563 2 A RESOLUTION OF THE PLANNING COMMISSION OF THE 3 CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A SCENIC CORRIDOR SPECIAL USE 4 PERMIT TO WIDEN A 4,600-FOOT (0.87 MILE) LENGTH OF 5 EL CAMINO REAL BETWEEN TAMARACK AVENUE AND CHESTNUT AVENUE IN THE MELLO II SEGMENT OF THE 6 LOCAL COASTAL PROGRAM AND WITHIN LOCAL FACILITIES MANAGEMENT ZONE 1 AND 2. 7 CASE NAME: EL CAMINO REAL ROAD WIDENING CASE NO.: SUP 07-04 8 9 WHEREAS, the City of Carlsbad, "Developer" has filed a verified application 10 with the City of Carlsbad regarding property owned by the City of Carlsbad and various owners, "Owners," described as 12 Public rights-of-way on a portion of Chestnut Avenue, on El 13 Camino Real between Tamarack Avenue to Chestnut Avenue, and properties identified by Assessor's Parcel Numbers 167- 14 230-24, 167-230-25, 167-154-15, 167-154-16, 167-080-33, 167- 15 080-42, and 167-080-41 16 ("the Property"); and 17 WHEREAS,' said verified application constitutes a request for a Scenic Corridor 18 Special Use Permit as shown on Exhibits "A" - "ZZ" dated June 3, 2009, on file in the 19 Planning Department, EL CAMINO REAL ROAD WIDENING - SUP 07-04, as provided by 20 Chapter 21.40 of the Carlsbad Municipal Code; and 21 ~~ WHEREAS, the Planning Commission did on June 3, 2009 hold a duly noticed 23 public hearing as prescribed by law to consider said request; and 24 WHEREAS, at said public hearing, upon hearing and considering all testimony 25 and arguments, if any, of all persons desiring to be heard, said Commission considered all factors 26 relating to the Scenic Corridor Special Use Permit. 27 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 28 Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. 2 B) That based on the evidence presented at the public hearing, the Commission 3 APPROVES EL CAMINO REAL ROAD WIDENING - SUP 07-04 based on the following findings and subject to the following conditions: Findings: 1. The proposed project conforms to the intent of the Scenic Preservation Overlay in that 6 grading of the steep slope on the east side of El Camino Real would be more aesthetically pleasing and naturally appearing than having to erect a tall retaining 7 wall in this area to accommodate the expanded roadway. The area will be hydro- seeded to make the slope more aesthetically pleasing and naturally appearing. The two proposed retaining walls on the west side of El Camino Real would be 9 constructed with a naturalized boulderscape architectural treatment that would look similar to existing conditions, and over time, the proposed drought resistant 10 landscaping would mature and further soften the visual appearance of the retaining walls. In addition, a native hydro-seed mixture will be sprayed on the disturbed slopes behind the retaining walls to give the area a more natural appearance. 12 2. The proposed project implements the goals and objectives of the General Plan in that the 13 project will enhance the roadway scenic quality, comply with the El Camino Real Corridor Development Standards, link two existing sidewalks to improve alternative 14 means of transportation, improve vehicle traffic flow, and will complete a street segment consistent with General Plan standards for prime arterials. 16 3. The project is consistent with the City's Landscape Manual (Section IV.C - Water Conservation Policies and Requirements, Section IV.D - Streetscape Program Policies 17 and Requirements, and Section IV.E - Slope Revegetation/Erosion Control Policies and Requirements) in that the Landscape Concept Plan takes into account the City's El Camino Real Corridor Development Standards by incorporating a median in landscape treatment that continues adjacent median designs. However, increased planting, and minimized hardscape, is proposed within the medians to off-set the 20 additional hardscape of the proposed road and sidewalk improvements. The Landscape Concept Plan includes low water use, minimization of fire hazards, 21 minimization of visual impacts of the proposed retaining walls, and stabilization of „ disturbed slopes. 23 Conditions; 24 1. Staff is authorized and directed to make, or require Developer to make, all corrections and modifications to the Special Use Permit document(s) necessary to make them 25 internally consistent and in conformity with final action on the project. Development shall occur substantially as shown in the approved Exhibits. Any proposed development, different from this approval, shall require an amendment to this approval. 27 2. This approval is granted subject to the approval of the Mitigated Negative Declaration 28 and Mitigation Monitoring and Reporting Program, and approval of CDP 07-22, HDP 07-02, and HMP 07-08 and is subject to all conditions contained in Planning PC RESO NO. 6563 -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Commission Resolutions No. 6560, 6561, 6562, and 6564 for those other approvals incorporated herein by reference. 3. Overhead utilities within the limits of the project shall be placed underground as required by City Council Policy Number 41. PASSED, APPROVED, AND ADOPTED at a regular meeting of the planning Commission of the City of Carlsbad, California, held on June 3, 2009 by the following vote, to wit: AYES: NOES: Commissioners Boddy, Dominguez, Douglas, L'Heureux, and Chairperson Montgomery ABSENT: Commissioner Baker ABSTAIN: MARTELL B.
