HomeMy WebLinkAbout2013-05-01; Planning Commission; Resolution 6970 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A MASTER PLAN AMENDMENT TO REDUCE THE PERCENT OF REQUIRED SINGLE-STORY RESIDENCES FOR PROPERTY GENERALLY LOCATED IN PLANNING AREAS 16, 17 & 18 OF THE ROBERTSON RANCH MASTER PLAN AND LOCATED NORTH OF CANNON ROAD AND WEST OF COLLEGE BOULEVARD IN LOCAL FACILITIES MANAGEMENT ZONE 14. CASE NAME: ROBERTSON RANCH PA 17 CASE NO: MP 02-03(D) WHEREAS, Brookfield Del Mar Builders, Inc., “Developer”, has filed a verified application with the City of Carlsbad regarding property owned by Brookfield Robertson PA 17, LLC, “Owner”, described as Lots 1 through 43 inclusive; Lots 64 through 88 inclusive; Lots 100 through 116 inclusive; Lots 141 through 159 inclusive; and Lots 190 through 194 inclusive; per Map No. 15682, filed in the office of the County Recorder of San Diego County as File No. 2008-0192971 on April 11, 2008 (“the Property”); and WHEREAS, said verified application constitutes a request for a Master Plan Amendment, the specific text revisions of which are shown on Exhibit “X” dated May 1, 2013, which are attached to this resolution and also on file in the Carlsbad Planning Division, MP 02-03(D) – ROBERTSON RANCH PA 17, as provided by MP 02-03 and Chapter 21.38 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on May 1, 2013, consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Master Plan Amendment; and PLANNING COMMISSION RESOLUTION NO. 6970 PC RESO NO. 6970 -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, on November 14, 2006, the City Council approved, MP 02-03, as described and conditioned in Planning Commission Resolution No. 6106 and City Council Ordinance No. NS-822; and WHEREAS, on October 15, 2008, the City Council amended MP 02-03 as described and conditioned in Planning Commission Resolution No. 6490 and City Council Ordinance CS-020; and WHEREAS, on December 16. 2009, the City Council amended MP 02-03(A) as described and conditioned in Planning Commission Resolution No. 6660 and City Council Ordinance CS-076; and WHEREAS, on December 4, 2012, the City Council amended MP 02-03(B) as described and conditioned in Planning Commission Resolution No. 6912 and City Council Ordinance CS-197. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission APPROVES of ROBERTSON RANCH PA 17 – MP 02-03(D) based on the following findings and subject to the following conditions: Findings: 1. The Planning Commission finds that the project, as conditioned herein, is in conformance with the Elements of the City’s General Plan, based on the facts set forth in the staff report dated May 1, 2013 including, but not limited to the following: the proposed minor modification of a special design criteria (reduction in the percent of required single story residences) does not increase the densities or change the boundaries of the subject property or involve the addition of a new use or group of uses not shown on the approved master plan or rearrange uses within the master plan. Therefore, the proposed amendment remains consistent with the previously approved master plan which was analyzed and found to be consistent with the City’s General Plan. 2. That all necessary public facilities can be provided concurrent with need, and adequate provisions have been provided to implement those portions of the Capital Improvement Program applicable to the subject property, in that the Master Plan includes conditions PC RESO NO. 6970 -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 requiring the completion of infrastructure identified in the Local Facilities Management Plan (LFMP) for Zone 14 and according to a financing plan approved by the City Council for LFMP Zone 14. 3. That the streets and thoroughfares proposed are suitable and adequate to carry the anticipated traffic thereon, in that the project will maintain the same number of residential units previously approved for Planning Area 17 and all streets required to serve the project will be constructed as previously proposed and approved. Conditions: 1. Staff is authorized and directed to make, or require Developer to make, all corrections and modifications to the Master Plan document(s) necessary to make them internally consistent and in conformity with final action on the project. Development shall occur substantially as shown in the approved Exhibits. Any proposed development, different from this approval, shall require an amendment to this approval. 2. Prior to the issuance of any permits for the project, the applicant shall submit to the City Planner a digital copy and a camera-ready master copy of the ROBERTSON RANCH MASTER PLAN – MP 02-03(D), in addition to the required number of bound copies. NOTICE TO APPLICANT An appeal of this decision to the City Council must be filed with the City Clerk at 1200 Carlsbad Village Drive, Carlsbad, California, 92008, within ten (10) calendar days of the date of the Planning Commission’s decision. Pursuant to Carlsbad Municipal Code Chapter 21.54, section 21.54.150, the appeal must be in writing and state the reason(s) for the appeal. The City Council must make a determination on the appeal prior to any judicial review. NOTICE Please take NOTICE that approval of your project includes the “imposition” of fees, dedications, reservations, or other exactions hereafter collectively referred to for convenience as “fees/exactions.” You have 90 days from date of final approval to protest imposition of these fees/exactions. If you protest them, you must follow the protest procedure set forth in Government Code Section 66020(a), and file the protest and any other required information with the City Manager for processing in accordance with Carlsbad Municipal Code Section 3.32.030. Failure to timely follow that procedure will bar any subsequent legal action to attack, review, set aside, void, or annul their imposition. DEVELOPMENT AND Robertson Ranch REGULATORY PROVISIONS Robertson Ranch Master Plan Page III - 88 May 1, 2013 3. At least 20 percent of the homes in these planning areas shall be designed as single-story. Single story is defined as a maximum plate-line of 15 feet and a maximum building height of 20 feet. Lofts are permitted subject to Carlsbad Municipal Code Section 21.04.330. Alternatively, a total of 25 percent of the homes in each neighborhood shall be designed as either single-story or modified single story homes, provided that no fewer than 15 10 percent of the homes in the planning area are designed as single-story homes. Homes designed as modified single story homes shall conform to the following criteria: Modified Single-Story. To qualify as a Modified Single-Story home, the structure must comply with the following criteria: A minimum of 60 percent of the area of the roof shall be single story. A two-story element may be added in the central portion of the front and rear elevation. For modified single-story, the livable space on the second floor shall not exceed 25 percent of the first floor lot coverage. The single story or Modified Single-Story units are intended to be strategically located in the lotting scheme, and distributed throughout the village. 4. Doors, porches, balconies and walkways should face the streets, to the extent possible, to promote social interaction along the streetscape. 5. Porches shall have a minimum depth of 6 feet and a minimum width of 10 feet. 6. Building elevations visible from the surrounding roadways shall feature enhanced elevations. 7. Side-loaded garages are encouraged to vary the street theme. 8. Three-in-a-row car garages that directly face the street shall not be allowed. 9. At least one elevation/plan shall include a two-car garage with two separate garage doors facing the street. 10. Single-story and modified single-story homes shall be considered as two separate floor plans. 11. The use of perimeter roadways which form a buffer between residential and open space land uses shall be encouraged. Where this situation occurs, a pedestrian trail is recommended along the open space side of the roadway. 12. Recreation facilities shall be integrated into the trail system and should be sited to take advantage of views where feasible.
