HomeMy WebLinkAbout2013-08-07; Planning Commission; Resolution 6994 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE CARLSBAD LOCAL COASTAL PROGRAM TO CHANGE THE DESIGNATIONS ON THE LOCAL COASTAL PROGRAM LAND USE PLAN FROM PLANNED INDUSTRIAL (PI) AND OPEN SPACE (OS) TO OFFICE (O) AND OPEN SPACE (OS) AND ZONING MAP FROM PLANNED INDUSTRIAL, QUALIFIED DEVELOPMENT OVERLAY ZONE (P-M-Q) AND OPEN SPACE (OS), TO OFFICE (O) AND OPEN SPACE (OS) ON 7.5 ACRES OF PROPERTY LOCATED AT THE SOUTHEAST CORNER OF PALOMAR AIRPORT ROAD AND HIDDEN VALLEY ROAD IN LOCAL FACILITIES MANAGEMENT ZONE 5 CASE NAME: KELLY CORPORATE CENTER CASE NO: LCPA 12-02 WHEREAS, California State law requires that the Local Coastal Program, General Plan, and Zoning designations for properties in the Coastal Zone be in conformance; and WHEREAS, The Allen Group, “Developer,” has filed a verified application with the City of Carlsbad regarding property owned by Kelly Corporate Center, LLC & IIA, LLC, “Owner,” described as Parcels 1, 2 and 3 of Parcel Map No. 19207, in the City of Carlsbad, County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County, April 9, 2003 as file no. 2003-0402795 of Official Records (“the Property”); and WHEREAS, said verified application constitutes a request for a Local Coastal Program Amendment as shown on Exhibit “LCPA 12-02” dated August 7, 2013, attached hereto, as provided in Public Resources Code Section 30514 and Section 13551 of California Code of Regulations Title 14, Division 5.5; and WHEREAS, the Planning Commission did on August 7, 2013, hold a duly noticed public hearing as prescribed by law to consider said request; and PLANNING COMMISSION RESOLUTION NO. 6994 PC RESO NO. 6994 -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Local Coastal Program Amendment; and WHEREAS, State Coastal Guidelines requires a six-week public review period for any amendment to the Local Coastal Program. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad, as follows: A) That the foregoing recitations are true and correct. B) At the end of the State-mandated six-week review period, starting on July 13, 2012 and ending on August 24, 2012, staff shall present to the City Council a summary of the comments received. C) That based on the evidence presented at the public hearing, the Commission RECOMMENDS APPROVAL of KELLY CORPORATE CENTER – LCPA 12-02, based on the following findings, and subject to the following conditions: Findings: 1. That the proposed Local Coastal Program Amendment meets the requirements of, and is in conformity with, the policies of Chapter 3 of the Coastal Act and all applicable policies of the Mello II segment of the Carlsbad Local Coastal Program not being amended by this amendment, in that the proposed Local Coastal Program Office (O) and Open Space (OS) land use designations and Office (O) and Open Space (OS) zoning designations are consistent with the proposed Office (O) and Open Space (OS) General Plan Land Use designation and the Office (O) and Open Space (OS) zoning designations; the project will not impact Environmentally Sensitive Habitat Areas and has previously protected the adjacent Open Space with conservations easements and management requirements and the payment of Agricultural Conversion Mitigation Fees have previously been collected with prior development for the funding of other agricultural programs. 2. That the proposed amendment to the Mello II segment of the Carlsbad Local Coastal Program is required to bring the property’s LCP Land Use and Zoning designations into consistency with the City's proposed General Plan Land Use and Zoning designations. . . . . . . . . .
