HomeMy WebLinkAbout2015-02-18; Planning Commission; Resolution 7088 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING PLANNED DEVELOPMENT PERMIT PUD 14-11 AMENDING EXISTING CONDITIONS OF APPROVAL REGULATING THE ADDITION OF PATIO COVERS, DECKS, AND HABITABLE ADDITIONS ON PROPERTY GENERALLY LOCATED NORTH OF PONTO DRIVE, SOUTH OF POINSETTIA LANE, EAST OF CARLSBAD BOULEVARD AND WEST OF THE RAILROAD TRACKS IN LOCAL FACILITIES MANAGEMENT ZONE 22. CASE NAME: HANOVER BEACH COLONY CASE NO.: PUD 14-11 WHEREAS, HANOVER BEACH COLONY HOME OWNER’S ASSOCIATION, “Applicant,” has filed a verified application with the City of Carlsbad on behalf of the individual property owners within the Hanover beach Colony subdivision previously described as: Portions of Lot 3 and the North 1/3 of Lot 4 of Section 29, Township 12 South, Range 4 West, San Bernardino Meridian, City of Carlsbad, San Diego County, State of California (“the Property”); and WHEREAS, said verified application constitutes a request for an amendment to existing conditions of approval through approval of a Planned Development Permit as provided by Chapter 21.45 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on February 18, 2015, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of persons desiring to be heard, said Commission considered all factors relating to the Planned Development Permit; and WHEREAS, on February 18, 2015, the Planning Commission approved PUD 14-11, as described and conditioned in Planning Commission Resolution No. 7088. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. PLANNING COMMISSION RESOLUTION NO. 7088 PC RESO NO. 7088 -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 B) That based on the evidence presented at the public hearing, the Commission APPROVES HANOVER BEACH COLONY – PUD 14-11, based on the following findings and subject to the following conditions: Findings: 1. The extent of the action being requested is the deletion of one condition in Planning Commission Resolution No. 4526, which eliminates unique development standards, in the form of the Trellis/Patio Cover and Balcony/Deck Plan, for additions of patio covers, decks, and habitable space within the Hanover Beach Colony. No aspect of the Hanover Beach Colony will be changed that could have an altering effect on the existing neighborhood’s consistency with the General Plan, Mello II Segment of the Local Coastal Program, Poinsettia Properties Specific Plan, Subdivision Ordinance, Inclusionary Housing Ordinance, or Growth Management Ordinance. 2. The proposed deletion of condition 13D from Planning Commission Resolution No 4526 and resulting reliance on the development standards found in Carlsbad Municipal Code Section 21.45.090 for additions, patio covers, and decks will not be detrimental to existing uses, or to uses specifically permitted in the area in which the proposed use is to be located, and will not adversely impact the site, surroundings, or traffic, in that the modification is limited to development standards applicable to individual residential lots and will not have a direct or indirect impact on neighborhood surroundings or circulation. 3. The deletion of condition 13D of Planning Commission Resolution No 4526 and resulting reliance on the development standards found in Carlsbad Municipal Code Section 21.45.090 for additions, patio covers, and decks will not adversely affect the public health, safety, or general welfare, in that they are specifically limited to individual residential lots. Conditions: 1. This approval is subject to all conditions contained in Planning Commission Resolution No. 4526 incorporated herein by reference except for Condition No. 13D which is deleted. . . . . . . . . . . . . . . . . . . . . . . . . . . .
