HomeMy WebLinkAbout2017-06-21; Planning Commission; Resolution 7247 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING AN APPEAL AND UPHOLDING THE DECISION OF THE CITY PLANNER TO APPROVE A MINOR SUBDIVISION TO SUBDIVIDE AN EXISTING 0.44-ACRE PARCEL INTO TWO PARCELS WITHIN THE ONE-FAMILY RESIDENTIAL (R-1) ZONE ON PROPERTY ADDRESSED AS 1274 PINE AVENUE, IN LOCAL FACILITIES MANAGEMENT ZONE 1. CASE NAME: 1284 PINE PARTNERS CASE NO: MS 16-05 (DEV 13014) WHEREAS, on July 21, 2016, Minor Subdivision MS 16-05, as shown as Exhibit “A” was filed with the City of Carlsbad; and WHEREAS, on April 12, 2017, pursuant to Section 21.54.060.B.2 of the Carlsbad Municipal Code, the City Planner held an administrative public hearing to receive comments on Minor Subdivision MS 16-05; and WHEREAS, on April 21, 2017, the City Planner approved Minor Subdivision MS 16-05; and WHEREAS, on May 1, 2017, the appellant timely filed an appeal with the Planning Division; and WHEREAS, the Planning Commission of the City of Carlsbad, on June 21, 2017, held a duly noticed public hearing to consider an appeal of the City Planner’s decision to approve Minor Subdivision MS 16-05; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the Planning Commission considered all factors relating to the appeal of the City Planner’s decision to approve Minor Subdivision MS 16-05; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That said appeal is denied. 3. That the findings of the City Planner in the Minor Subdivision administrative approval letter dated April 21, 2017, on file with the Planning Division and incorporated herein by reference constitute the findings of the Planning Commission in this matter.
