HomeMy WebLinkAbout1952-10-07; City Council; 3001; Public drunkeness/intoxication prohibited & fix violation punishments The City Council of the City of Garlsbad does ordain as follows: No person shall be or appear on any public street or other public glace in the City in a state of drunkenness or intoxication, SXCTIOX 2. ‘No person shall be in any private house or on any private premises in the City in a state of drunkenness or intoxication to the annoyance of any other person. SECTION 3. DR-SS. 13T VEHICLES. No person shall enter or be in or on any automobile or other motor vehicle on any public street or other public place in the City in a state of or or drunkenness or intoxication. SECTION 4. DRU”KEEp3NESS. IN DABCE FULL. No person in a state of drunkenness or intoxication shall enter, be remain in any public dance hall, public dance, club dance, skating rink, place of public entertaiment in the City. SECTION 5, BRIXKXXG IN PUBLIC. Xo person shall drink any malt, spirituous or vinous liquor contain- ing more than one-half of one per cent of alcohol by volume in or upon any public street or public park within the City, whether such person is or is not in or upon any automobile or other vehicle or conveyance. .. .f c SECTIOH 6, PROFANITY. No person shall use vulgar, profane, or indecent language on any public street or other public place or in any public dance hall, public dance, club dance, skating rink, or place of business open to public patronage SECTION 7'. IKDECENT CONDUCT. No person shall publicly expose his person, or make indecent gestures, or use or make any profane, lewd or indecent language or noise within the City, whereby the good order is violated, or the public peace is disturbed or public decency is outraged. SECTIOES8, lJ'BX3CESSARy XOISE, No person shall make any unnecessary noises or sounds which are physically annoying to persons of ordinary sensitiveness or which are so harsh or so prolonged or unnatural or unusual in their use, time or place as to occasion physical discomfort, SECTfUR 9. PENALTY FOR VIOLATIOM. Any person violating any of the provisions of this Ordinance shall be guilty of a misiberneanor and upon conviction thereof shall be punished ' by imprisonment in the Jail provided by the City for a period not to exceed six (6) months or a fine of not to exceed Five Hundred ($5OO,OO) Dollars, or by both, SECT LOP 1 0 , If any provision of this Ordinance, or the application thereof to any person or circumstance is held to be invalid, the remainder of this Ordinance or the application of said provisions to other persons or cir- cumstances shall not be affected thereby, CONS T I TUT I_OlTALI TY. SECTIOB 11. E3'FECTIVjE DATE. . This Ordinance is hereby declared to be urgent and necessary for the im-ediate preservation of the public peace, health and safety and shall take effect and be in force forthwith from and after its passage and approval. The following is a statement of such urgency: That there is no Ordinance of the City of Carlsbad dealing with the subject matter hereof, and said Ordinance is immediately required in order to provide for the protection and preservation of the public peace, health and safety. SECTLOW 12. The City Clerk of the City of Carlsbad is hereby directed to cause 1 this Ordinance to be published once in the Carlsbad Journa.1, a newspaper published and of general circulation in said City of Carlsbad. PASSED, ADOPTED AhTD ORDXRID PUf3LISHED by the City Council of the \ City of Carlsbad, California, this 7th day of October, 1952, by the following vote: AXES= Councilman Sde, Castorena, Grober and Xayor McClellan.
