SO10 AN OEiDINANCE 0% THE CITY OF CAEXLSBAD PROHIBITING TEE DUPE'Xm OR DEPOSITING OF TRASH, RUBBISH, REFUSE, EIVfPTY % CANS, ENPTY BOTTLES, BZOKEN GLASS, OR OTHER WASTE HAT- TER OR INFLAMABLE SUBSTANCE UPON ANY PUBLIC OR PRIVAm PROPERTY WI'GHIN THE CITY. The City Council of the City of Carlsbad does hereby ordain as I" - follows : SECTION 1, DWIMITION OF RUBBISH OR WASTE MATERIAL. 'ITrashn for the purpose of this Ordinance shall mean empty or broken bottles or glass, cans, paper, wood scraps, brush, plant trimmings, garbage, lawn trimmings, or any discarded material and combustible material. SECTION 2, It shall be and is hereby declared unlawful for i any person, persons or corporations to deposit any trash upon any beackr; street, parkway, alley, park, or public place in said City of Carlsbad. SECTION 3& It shall be and is hereby declared unlawful for any person, persons or corporations to deposit or dump any trash upon any vacant lots or unoccupied premises within the said City of Carlsbaa with OF without the owner's consent. SECTION 4; The existence of any trash upon any private property in the City of Carlsbad is hereby declared to be a public nuisance. SECTION 5, The Public Works DiPector of the City of Carlsbad is hereby authorized and- empowered to abate any public nuisance as defined in Section 4 above. notice to remove any trash that constitutes a public nulsanrce as above defined to the owner upon whose property the public nuisance exists. The owner of' the property shall, within ten (10) days after receipt of said notice, remove all trash that constitutes the public nuisance. The Public Works Director shall give a ten day In the event the owner shall not so remove the trash as requested by the Public Works Director, then the Public Works Director is hereby authorized and empowered to have said trash removed and to submit to the owner of the premises a bill for the costs of such removal, SECTION 6, Any person violating any of the provisions of this Ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by imprisonment in the jail provided. by the City of Carlsbad for not exceeding six (6) months, or by a fine of not to exceed Five Hundped ($500,00) Dollars, or by both such imprisonment and fine. SECTION 7, This Ordinance shall take effect and be In force on the thirty-first day from and after its final passage.
