Director appts....ORDINANCE NO. 1015-A 1 AN ORDINANCE AMENDING ORDINANCE NO. 1015, PROVIDING THAT THE DIRECTOR OF CIVIL DEFENSE 2 AND DISASTER SHALL BE APPOINTED BY THE MAYOR, AND PROVIDING FOR AN ASSISTANT DIRECTOR OF 3 CIVIL DEFENSE AND DISASTER TO BE APPOINTED BY THE DIRECTOR OF CIVIL DEFENSE AND DISASTER, 4 SUBJECT TO APPROVAL BY THE CITY COUNCIL, 5 6 The City _Council .of the 'City " of Carlsbad does ordain as 7 follows: 8 SECTION 1* .SECTION 3-B AND 3-C OF ORDINANCE NO. 1015 AMENDED. 9 10 11 12 Section 3-B and 3-C of Ordinance No, 1015 are hereby amended to read as follows: "B*; The. Director of Civil Defense and Disaster, who shall be appointed by the Mayor, shall be 13 Vice chairman. 14 C, The Assistant Director of Civil Defense and 15 Disaster, who shall be appointed by the Director 16 of Civil Defense and Disaster, subject to the 17 appointment being approved by the City Council, 18 who, under the supervision of the Director, shall 19 develop civil defense and disaster plans and organ 20 ize the civil defense and disaster program of this 21. city and shall have other duties as may be assigned 22 by the Director," 23 SECTION 2.., SECTION 5 OF ORDINANCE NO. 1015 AMENDED. 24Section 5 of Ordinance No. 1015 is hereby amended to read as follows: 25 "There is hereby created the office of Director of 26 Civil Defense and Disaster, Such officer shall be 27 appointed by the Mayor, .subject to the approval of 28 the City Council." 29 The remainingportions of Section 5 not in conflict herewith remain 30 unaltered, 31 SECTION 3. SECTION 6-E of Ordinance No, 1015 amended. Section 326-E of Ordinance No* 1015 is hereby amended to read as follows: 1 "To execute and 'perform all the special powers 2 conferred upon him by this ordinance or by resolu- 3 tion adopted pursuant thereto, all powers conferred 4 upon him by any statute, agreement approved by the 5 City Council, or by any other lawful authority, and 6 7 Code, to exercise complete authority over the City 8 and to exercise all police power vested in the City 9 by the Constitution and General Laws." 10 11 in conformity with Section 38791 of the Government SECTION 4. EFFECTIVE DATE. This ordinance is hereby declared to be an emergency measure, necessary for the public peace, health 12 and safety, and shall take effect immediately. The followingis a 13 statementshowing its urgency: 14 That the present form of organization plases undue responsibilities upon the City Clerk, and that this 15 ordinance is regulated so as to enable a Director of Civil Defense and Disaster to be appointed who 16 can devote a fuller portion of time to his duties, 17 SECTION 5.� PUBLICATION. The City Clerk of the City of 18 Carlsbad is hereby directed to cause this ordinance to be published 19 once in the Carlsbad Journal,, a newspaper published and of ' general 20 circulation in said City of Carlsbad. 21 PASSED, APPROVED AND ADOPTED at a regular meeting of the City 22 Council of said City held on the 4th day of January, 1955, by the 23 following vote. 24 25 26 27`' 28 29 30 31 ATTEST: 32 AYES: Castorena, Helton, Ede, Sutton and McClellan NAYS: None ABSENT: None ,TY,fra C.'D.
