ORDINANCE NO. 3024 AN ORDINANCE OF THE CITY OF CARLSBAD M?II\IG IT UNLB:JJFUL FOR ANY PERSON TO HAVE IN THEIR POSSESSION ANY KNIFE, WHOSE BLADE IS ACTIVATED AND CAUSED TO E@ OPEN BY A SPRING MECWISM, AND PROVIDING A P€NALTY FOR VIOLATION TEREOF. - The City Council of the City of Carlsbad does ordain as follows : SECTION I. It shall be unlawful for any person to have in their possession any knife, whose blade is activated and caused 18 to be open by a spring mechanism. 11 SECTION 11. The possession of a knife whose blade is 12 activated and caused to be open by a spring mechanism is herewith 13 declared to be a nuisance, and shall be confiscated and summarily 14 15 by the Police Department of the City of Carfsbad, 16 SECTION 111, Any person violating any of the provisions 17 of this ordinance shall be guilty of a misdemeanor, and upon 18 19 20 21 prisonment. 22 SECTION IV. If any provision of this ordinance, or the 23 application thereof, to any person or citizen is held invalid, destroyed, except when needed to be retained for evidence purposes conviction thereof shall be punishable by a f'ine of not more than $500.00, or by imprisonment in the jail provi ed by the City for a term not to exceed six (6) months, or both such fine and im- 24 such invalidity shall not effect any other provisions, or the 25 application thereof, which can be given effect without the invalid 26 portion or application, and to this and the provisions of this 27 ordinance are declared to be severable. 28 SECTION V, This ordinance shall take effect and be in 29 30 SECTION VI.
