AN ORDINANCE OF THE CITY OF CARLSBAD
AMENDING ORDINANCE NO. 8009 OF THE CITY OF CARLSBAD, BY ADOPTING THE 1961 EDITION OF THE UNIFORM BUILDING CODE, ESTABLISHING BUILDING PERMIT FEES, ESTAB- LISHING A FEE FOR REISSUAJYCE OF INSPEC-
TION RECORD CARD, AND lM.A.KXNG VIOLATION
THEREOF A MISDEMEANOR.
The City Council of the City of Carlsbad does ordain as follows:
SECTION 1. SECTION 1 OF ORDINANCE NO. 8009 AMENDED.
Section 1 of Ordinance No. 8009 of the City of Carlsbad is hereby amended to
read as follows:
ir Section 1. Uniform Building Code Adopted. That certain
document, three copies of which are on file in the office of the City
Clerk, being marked and designated as 'Uniform Building Code,
1961 Edition, Second Printing, Volume I, Copywrited by the
International Conference of Building Officials,
as the building code of the City of Carlsbad, for regulating the
erection, construction, enlargement, alteration, repair, moving,
removal, demolition, conversion, occupancy, equipment, us e,
height, area and maintenance of all buildings or structures in the
City of Carlsbad; providing for the issuance of permits and collection
of fees therefor; providing penalties for violation of such code; and
declaring and establishing fire zones. Each and all of the regulations,
provisions , penalties, conditions and terms of such 'Uniform Building
Code, 1961 Edition, Second Printing, Volume 1, Copywrited by The
International Conference of Building Officials', on file in the office
of the City Clerk, are hereby referred to, adopted and made a part
hereof as if fully set out in this ordinance; provided, however, that
any of the provisions of said Uniform Building Code as herein adopted
which are in conflict with any of the provisions of this ordinance, shall
is hereby adopted
be superseded by the provisions of this ordinance. $1
SEC,TION 2. SECTION 3 OF ORDINANCE 8009 AMENDED, Section 3

follows:
Section 3. Building Permit Fees. In lieu of and superseding It
the provisions of Section 303, including Table No. 3-A of said Uniform
Building Code, the following provisions are substituted:
Building Permit Fees. A fee for each building permit shall be
paid to the Building Official as set forth in Table 3-A.
The determination of the value or valuation under any of the pro-
$isions of said Uniform Building Code shall be made by the 3uilding
Official.
Where work for which a permit is required by said Uniform
Building Code is started or proceeded with prior to obtaining said
permit, the fees above specified shall be doubled, but the payment
of such double fee shall not relieve any persons from fully complying
with the requirements of said Uniform Building Code in the execution
of the work nor from any other penalties prescribed herein.

SECTION 3. SECTION 5 OF ORDINANCE 8009 AMENDED. Section 5
of Ordinance No. 8009 is hereby amended to read as follows:
Section 5. Violations and Penalties. It shall be unlawful for any 11
person, firm, or corporation to erect, construct, enlarge, alter,
repair, move, remove, demolish, convert, occupy, equip, use or
maintain any building or structure in the city, or cause the same to
be done, contrary to or in violation of any of the provisions of said
Uniform Building Code. Any person, firm or corporation violating

any of the provisions of the said Uniform Building Code shall be
deemed -silty of a misdemeanor, and each such person shall be
deemed guilty of a separate offense for each and every day or
portion thereof during which any violation of any of the provisions
of the said Uniform Building Code is committed, continued, or
permitted. ''
SECTION 4. ORDINANCE NO. 8009 AMENDED BY ADDING SECTION
10. Ordinance No. 8009 is hereby amended by adding Section 10, which section
shall read as follows:

Section 10. Reissuance of Inspection Record Card. If, for any I1
reason, it becomes necessary for the Building Official to reissue to
the permit holder or his agent a duplicate inspection record card,
or building permit card, a fee of $1.00 shall be paid to the Building
Official for each said reissuance. tr
SECTION 5. ORDINANCE NO. 8009 AMENDED BY ADDING SECTION
Ordinance No. 8009 is hereby amended by adding Section 11, which section 11.
shall read as follows:

"Section 11. Ordinances Repealed. All ordinances or parts of
ordinances in conflict with Ordinance No. 8009, as amended, are
hereby repealed. *I
SECTION 6. EFFECTIVE DATE. This ordinance shall take effect
and be in force on the thirty-first day from and after its final passage.
SECTION 7. PUBLICA,TION. The City Clerk of the City of Carlsbad
is hereby directed to cause this ordinance to be published once in the Carlsbad
Journal, a newspaper published and of general circulation in said City of Carlsba
First read at a regular meeting of the City Council of the City of
Carlsbad held on the 4th day of June, 1963, and finally passed, approved and
adopted at a regular meeting of said Council held on the 18th day of June, 1963,
