HomeMy WebLinkAbout1963-11-19; City Council; 1085; East Carlsbad annexation 2.4QRDJJANCE NO. 1085 AN ORDKE*TANCE OF TEE CITY OF CARLSBAD APPROVD!G THE ANNEXATION OF CERTAIN UNINHAEITED TERRITORY, DESIGNATED "EAST CARLSBAD ANNEXATION 2.4''. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CA RLSBAD: WHEREAS, on the 17th day of September, 1963, the Cccacil of the C City of Carlsbad did pass and adopt Resolution No. 938 giving notf.ce of the proposal to annex certain uninhabited territory to the City of Carlsbad, said territory being therein designated as "East Carlsbad Annexation 2.4", said Resolution describing the boundaries of the territory proposed to be annexed; and WHEREAS, said Resolution No. 938 did contain a notice of the day, hour and place when and where the Council of the City would hear protests made by any person owning real property within the territory proposed to be annexed, the time of said hearing being not less than forty nor more than sixty days from the date of passage of said Resolution; and W-HEREAS, on the 5th day of November, 1963, at the hour of 7:30 P. M. in the Council Chambers in the City Hall of the City of Carlsbad, County of San Diego, State of California, said time and place being the day, hour and place fixed in said Resolution No. 938 for hearing protests to the said annexation, the said City Council did hear and pass upon all protests made to the proposed annexation and did determine as set forth in Resolution No. 950, that protests had not been made by the owners of one-half of the value of the privately owned territory proposed to be annexed as shown by the last equalized assessment roll, nor by public owners of one-half of the value of the publicly owned territory proposed to be annexed as determined by said legislative body; and WHEREAS, said territory is contiguous to the City of Carlsbad, and is uninhabited territory in the County of San Diego; NOW, THEZEFORE, the said Council of the City of Carlsbad does hereby approve the annexation of the territory hereinafter described to the City of Carlsbad, and does hereby further ordain that the said territory be and is hereby annexed to the City of Carlsbad, That said territory, the annexation of which to the City of Carlsbad is herein approved, is all that territory situate in the County of San Diego, State of California, more particularly described in Exhibit "A", attached i hereto and made a part hereof as if fully set forth herein. - E€i’FE,CTIIF bATE, This ordinance shall take effect and be in force on the thirty-first day from and after its adoption. The City Clerk of the City of Carlsbad is hereby directed to czuse this Ordinance to bk published once in the Carlsbad Journal a newspaper published and in general circulation in the said City of Carlsbzd. The Cit-,- .-- Clerk of the City of Carlsbad is hereby directed to prepare under the seal of the City of Carlsbad a certified copy of this ordinance, giving therein its date of passage, and effective date, and to transmit said copy to the Secretary of State of the State of California.
