ORDINANCE NO, 9164 AN ORDINANCE OF THE CITY OF CARLSBAD AMENDING ORDINANCE NO. 9060, CHANGING CERTAIN DESIGNATED PROPERTY FROM ZONE R-I TO ZONE R-T, IN THE CITY OF CARLSBAD. The City Council of the City of Carlsbad does ordain as follows: SECTION 1. SECTION 302 OF ORDINANCE NO. 9060 AMENDED. Section 302 of Ordinance No. 9060 is hereby amended to provide that the follow- ing lands described be changed in zone from Zone R-1 (One-family residential) to R-T (Residential Tourist), said lands being situated in the City of Carlsbad, County of San Diego, State of California, more particularly described as: That portion of Tract 233 of Thum Lands in the City of Carlsbad, County of San Diego, State of California, according to the Map thereof No. 1681 filed in the Office of the Recorder of San Diego County December 9, 1915 describc as follows: Beginning at the most Easterly corner of Lot 11 of Harbor Estates according to the Map thereof No. 3386 filed in the Office of the Recorder of San Diego County March 1, 1956; being a point on the Northeasterly boundary of land conveyed to E. Thacher by Deed dated November 16, 1945 and recorded in Book 2035 Page 81 Official Records; thence along the boundary of said Thacher's land, South 28" 39* East 436.43 feet, South 72* 25T West 383.84 feet and North 28" 39' West 482. 75 feet to the most Southerly corner of Lot E of said Harbor Estates; thence along the boundary of said Harbor Estates, North 61" 21* East 60.00 feet; thence South 28O 39' 00" East 120.00 feet; thence North 61" 21' 00'' East 136.70 feet to the point of beginning of a non- tangent 22.50 foot radius curve concave Southwesterly the center of which bears South 61" 211 00" West from said point; thence along said curve Southerly, through a central angle of 43" 36* 10" a distance of 17.12 feet to the beginning of a reverse curve forming a cul-de-sac and having a radius oJ 50.00 feet; thence counter clock wise along said curve through a central angle of 2674 12* 20" a distance of 233. 18 feet to the beginning of a reverse curve concave Northeasterly having a radius of 22.50 feet; thence Northwest along said curve through a central angle of 43" 36' lQ'* a distance of 17.12 fe thence North 61" 215 00" East 120. 00 feet to the point of beginning. Excepting therefrom, all that portion lying Northerly of the following descril line: Beginning at a point on the boundary of said Thacher*s Land distance South 28" 39' East 60.00 feet from said most Easterly corner of Lot 11 of Harbor Estates; thence South 61" 21' West 376.70 feet to a point on the Southerly prolongation of the Westerly boundary of said Harbor Estates, distance 180, 00 feet Southerly from the most Southerly corner of Lot 8 of said Harbor Estates, said point being the terminus of the described line; SECTION 2. ZONING WLAP AMEXDMENT NO. 62 ADOPTED, The location and boundaries of said zone change, herein ordained, are to be shown on the zoning map amendment No. 62, which map is attached hereto and made a part of the ordinance. 1 2 3 4 5 6 7 8 9 10 11 12 SECTION 3. EFFECTIVE DATE. This ordinance shall take effect and be in force on the thirty-first day from and after its final passage. SECTION 4. PUBLICATION. The City Clerk of the City of Carlsbad is hereby directed to cause this ordinance to be published once in the Carlsbad Journal, a newspaper published and of general circulation in said City of Carlsba . First read at a regular meeting of the City Council held on the 7th day of r April, 1964, and finally passed, approved and adopted at a regular meeting held on the 21st day of April, 1964, by the following vote, to wit: I AYES: Councilmen McPherson, Guevara, Bierce, Neiswender and Hughes. NOES: None ABSENT: None I
