CITATION OF MSTED PERSON FOR APPEARANCE BE- 'ORE MAGISTRATE, In the event any person arrested for a vio- lation of any ordinance of the City of Carlsbad, which is wnishable as a misdemeanor, is not immediately taken before 1 magistrate, the arresting officer shall. prepare in duplicate written notice to appear in court, containing the name and iddress of such person, the offense charged and the time and dace when and where such person shall appear in court, The westing officer shall deliver one (1) copy of the notice ,o appear to the arrested person and the arrested person in Irder to secure release must give his written promise so to ppear in court by signing the duplicate notice, which shall e retained by the officer, Thereupon the arresting officer hall forthwith release the person arrested from custody, The fficer shall, as soon as practicable, file the duplicate otice with the magistrate before whom the arrested person is otified to appear. SECXION 2, EFFECTIVE DATE, URGENCY. SECXION 3. PUBLICATION. The City Clerk of the City of krlsbad is hereby directed to cause this ordinance to be pub- .ished once in the Carlsbad Journal, a newspaper published and If general circulation in said City of Carlsbad. PASSED, APPROVED AND ADOPTED by the City Council of the Xty of Carlsbad at a regular meeting of the Council held on he 4th day of August, 1964, by the following vote, to wit: : Councilmen Atkinson, Dunne, Neiswender and Jardine.
