SUBSECTION 10 OF SECTION 417 OF ORDINANCE 80.9050 AMENDED. hereby amended to read as follows: Subsection 10 of Section 417 of Ordinance No. 9050 is "(10). The planting of street trees in the parkway area in front of each lot in the subdivision pursuant to the following standards and conditions: (a) All trees shall be of a variety listed on the then current street tree list. All trees shall be planted in holes twice the size of the container and in no case less than a (c) a minimum of twenty-four inches wide by thirty inches deep, and shall be back filled with appro imately two shovels full of 50% organic matter, mixed with approved top soil. All trees shall be staked with a minimum of one eight foot long two inch by two inch split red (d) wood stake installed adjacent to the outside of the tree ball, and shall be tied with at least two tree ties of copper wire and hose, canvas, 01 equivalent. 1 feet in diameter shall be formed around the base of all trees and shall be filled with water at the time of planting. (f) The subdivider shall enter into an adequately assurred agreement with the City that he will maintain all street trees in the subdivision until the lot in front of which they are planted is occupied. 23 24 25 (9) Conditional exceptions may be granted to the above stated requirements regarding street trees upon application to and approval of the Barks and Recreations Department of the City of Carlsbad and the City Manager of the City of Carlsbad." SECTION 2. EFFECTIVE DATE. This ordinance shall take effect and be in force on the thirty-first day from and after its adoption. SECTION 3. PUBLICATION. The City Clerk of the City of s hereby directed to cause this ordinance to be published once in the Carlsbad Journal, a newspaper published and of general circulation in said City of Carlsbad.
