ORDINANCE NO. 9176
AN ORDINANCE OF THE CITY OF CARLSBAD AMENDING ORDINANCE NO. 9060, CHANGING CE RTA I N DES I GN ATE D P RO P E RTY FROM ZON E R-2 TO ZONE R-3 IN THE CITY OF CARLSBAD.
The City Council of the City of Carlsbad does ordain as
foll ows :
SECTION 1. SECTION 302 OF ORDINANCE NO. 9060 AMENDED.
Section 302 of Ordinance No. 9060 is hereby amended to provide that
the following lands described be changed in zone from Zone R-2
(Two family residential) to Zone R-3 (Multiple-family residential),
said lands being situated in the City of Carlsbad, County of San
Diego, State of California, more particularly described as:
Lots 1, 2, 3, 4, 5 and 6 in Block B, Resubdivision of a portion of Alles Avocado Acress Map No. 2027 in the City of Carlsbad, County of San Diego, State of California;
EXCEPTING THEREFROM the Southeast 63.41 feet lying Southwest of a line Beginning at a point on the Southeast line of Lot 1, North 61" 18' 38" East (North 61" 21' East, Record) 87.77 feet from the Southwest corner of said lot; thence North 28" 41' 22" West (North 28" 39' West, Record) to the North line of said Southeast 63.41 feet in Lot 1, Block 5, Re- subdivision of a portion of Alles Avocado Acres, Map No. 2027, in the City of Carlsbad. EXCEPTING therefrom the following described parcel of land. Beginning at the Southwest corner of Lot 1, Block B, Resubdivision of a portion of Alles Avocado Acres, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 2027, filed in the office of the County Recorder of said San Diego County; thence North 61" 21 ' 52" East (Record North 61" 21 I East) along the Southerly line of said Lot 1, a distance of 8.00 feet to the beginning of a tangent 8.00 foot radius curve, concave Northerly; thence Westerly along the arc of said curve through an angle of 89" 58' 38", a distance of 12.56 feet to a point in the Westerly line of said Lot 1; thence South 28" 39' 30'' East (Record South 28" 39' East) 8.00 feet to the Point of Beginning.
AND EXCEPTING THEREFROM freeway opening portion of Lot 1;
SECTION 2. ZONING MAP AMENDMENT NO. 68 ADOPTED. The
location and boundaries of said zone change, herein ordained, are to
be shown on the zoning map amendment No. 68, which map is attached
hereto and made a part of the ordinance.

SECTION 3. EFFECTIVE DATE. This ordinance shall take
effect and be in force on the thirty-first day from and after its
final passage.
SECTION 4. PUBLICATION. The City Clerk of the City of
Carlsbad is hereby directed to cause this ordinance to be published
once in the Carlsbad Journal, a newspaper published and of general
circulation in said City of Carlsbad.
First read at a regular meeting of the City Council held on
the 6th day of April, 1965, and finally passed, approved and adopted
at a regular meeting held on the 20th day of April, 1965, by the
following vote, to wit:
AYES:Councilmen Dunne, Neiswender, Atkinson, and Hughes.
NOES: None
ABSENT: None
ABSTAINED: Councilman Jardine
