The City Council oE the City cf Carlsbaci does srdair, as fallows
-__I- SECTIGN I: Sub-paragraph (e) of paragraph I of Section 11 02
CERTAIN PORTIGXS OF SECTIOi;; 11 OF CRDINANCE -- --
Ordinance Number 8038 is hereby amended to read as falloi3ls:
"(e] "FRE5,ilAU". The term freeway shz1L be deerne6 to mean a
highway in res2ect to which tine owners of abutting lan2:s have no
right or easement of zccess to or fron their abutting lands o:c in
respect to which such oi4ners have only limited or restricted right
or easement of access, zni: whick is declared to be such In corqlianc
vith the Streets and Highways Code of the State of California.

SECTION __D 2: Sub-paragraph I1 of Section 11 of Ordinance number
8038 is hereby amended to read as follows:
"11. Advertising Disylays - Adizcent to Freeways. ido advertis-
iizg display skall be place6 or maintained. on property aii.ja.cent to a
section of freeway or landscaped freeway if the advertising 6isplaye
is designed to be viewed primarily by persons traveling on such
section of freeway or landscaped freeway. In no event shall any
advertising display be placed or naiIztained within 660 feet from the
edge of any section of freeway or landscaped freeway."
SECTIGN 3: Sub-paragraph (d) is hereby added to paragraph 111 ---
of Section 11 of Ordinaxce Number 8035, which subparagraph shail
read 2.s fsllo:iTs:
"(d) TQ advertise the City of Carlsbad, provided however, that
no fliore than one such sigii may be placed. at each freeway entrance to
the City."
SECTION 4: __I ParcIgraph IV of Section 11 of Ordinance Number 8038
is hereby amended to read as follows:

"IV, Removal of Prohibited -- Displays. Any advertising structur
or sign which is now, or hereafter may be, in violation of the pro-
visions hereof shall be removed within three (3) years from the
effective date of this ordinance,"
SECTION 5: If any portion of this ordinance is, for any reason
held to be invalid or unconstitutional, by the decision of any court
of coxrpetent jurisdiction, such decision shall not affect the valid-
ity of the remaining porticns thereof.
SECTION 6: This ordinance shall take effect and be in force on -
the thirty-first day froix and after its adoption.
SECTION 7: The City Clerk of the City of Carlsbaci is hereby ---
directed to cause this ordinace to be published once in the Carlsba
Journal, a newsgaper yublished and of general circulation in the Cit.
