I ORDINANCE NO. 9186 2 -3 4 5 AN ORDINANCE OF THE CITY OF CARLSBAD AMENDING SECTIONS 1507 AND 1508 OF ORDINANCE NO. 9060, REGARDING TEMPORARY REAL ESTATE OFFICES AND SIGNS. The City Council of the City of Carlsbad does ordain as 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 3o 31 32 follows: SECTION 1. SECTIONS 1507 AND 1508 OF ORDINANCE NO. 9060 AMENDED. Sections 1507 and 1508 are hereby amended to read as fQllOWS: SECTION 1507: TEMPORARY REAL ESTATE OFFICE. " In any newly created subdivision, the subdivider or his assignee may operate a temporary real estate office for the purpose of selling lots in said subdivision only. Such use shall cease no later than one year from the date of the recording of the final subdivision map of said subdivision, unless the Planning Commission, for good cause shown, shall allow a longer period of time, up to one (1) year per application therefore, for such use. The procedure for applying for such a longer period of time for such use and for appealing from a decision of the Planning Commission on such an application shall be the same as that for a vari- ance under this Ordinance." SECTION 1508: TEMPORARY REAL ESTATE SIGNS. " In any newly created subdivision, the subdivider or his assignee may maintain two temporary real estate billboards, not to exceed 50 square feet in area per face, or one billboard not to exceed in area of 100 square feet per faceg for the purpose of selling lots in said subdivision only. Such use shall cease no later than one year from the date of the recording of the final subdivision map of said subdivision, unless the Planning Commission, for good cause shown, shall allow a longer perfod of time, up to one (1) year per application therefore, for such use. The procedure for applying for such a longer period of time for such use and for appealing from a decision of the Planning Commission on such an application shall be the same as that for a variance under this Ordinance." SECTION 2. EFFECTIVE DATE. This Qrdinance shall take affect immediately. It is hereby declared that the passage of this Ordinanc? is necessary for the immediate preservation of the public peace, health, and safety, in that there is presently no procedure for allow- ing the use of temporary real estate offices and signs after one (1) 1 year has passed from the filing of the final subdivision map, and i llowing vote, to wit: orthing, Neiswender, Atkinson, Dunne and NOES: None. ABSENT: None. Carlsbad, California ..3 4 5 6 7 8 g 10 11 12 13 -2- this has caused a situation to arise in which lots which were in- tended to be sold and built upon are remaining in the hands of the subdivider because of lack of suitable and proper sales procedures, and the holding of unimproved property by subdividers gives rise to trash and weed nuisances on lots, encourages vandalism, and re- duces city tax revenues. SECTION 3. PUBLICATION. The City Clerk of the City of Carlsbad is hereby directed to cause this ordinance to be published once in the Carlsbad Journalp a newspaper published and of general circu- lation a’n said City of Carlsbad.
