All land and/or easements required by this ordinance hall be granted to the City of Carlsbad without cost to the City nd free of all liens and encumbrances. SECTION 3. PRIVATE DEVELOPMENT CONDITIONS. The following onditions shall apply with respect to any development after the ffective date of this ordinance of the property described in iection 1 hereof: A. The water main on Garfield Street from Acacia Avenue to tedwood Avenue shall be replaced with an 8" water main. B. The 3" water main on Juniper Street from Garfield Street ;o the A.T. & S.F. Railroad shall be replaced with a 6" water nai n. C. Curb, gutter, sidewalk, pavement and turn around shall 3e constructed on Juniper Street from Garfield Street to the A.T. & S.F. Railroad. D. E. Sidewalk and turn around shall be constructed on Hemlock. Underground electric and telephone distribution and service facilities, including building services; ornamental street 1 i ghts 5 necessary drainage and miscell aneous faci 1 i ties shall be required for all s F. All densities shall conform with ensities prescribed in the City of Carlsbad General Plan, adopted May 17, 1966, or G. That public improvements be constructed as outlined in 1 thru 5 or agreement to do so prior to issuance of a building permit. H. The following shall be granted to the City of 3 Carlsbad before any building permit will be issued for the devel- 11 6 7 8 9 10 12 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31. 32 411 opment of the property described in Section 1 hereof: I ground power and telephone, street tree planting, street light, storm drain and any other improvements deemed necessary by the City Engineer shall be installed in conformance with City Stan- dards and indicated on an approved improvement plan prior to the issuance of a building permit. 4 B. All lands necessary for street widening shall be dedi- cated to the City of Carlsbad prior to approval of said improve- ment plan. C. A grading plan shall be submitted prior to the issuance of a building permit. SECTION 5. ADMINISTRATION AND ENFORCEMENT. The Building Department shall not approve any building for occupancy until the Planning Director has certified that all the conditions of this ordinance have been satisfied. The Planning Director of the City of Carlsbad is designated as the enforcing officer of this Specific Plan. His decision shall be final as to whether the subject property has been properly developed and improved. However, the owners of the subject property may appeal to the City Council any decision of the Planning Director relative to this Specific Plan. Such appeal shall be in writing and filed wi the City Clerk within 10 days following the receipt of the decision of the Planning Director. The City Council's decision shall be final. SECTION 6. EFFECTIVE DATE. This Ordinance shall be effective 30 days after its adoption. The City Clerk of the City of Carlsbad shall certify to the adopti n of this Ordinance and cause it to be published once in after its ad Carlsbad Journal within fifteen (15) days -3- I I A.
