HomeMy WebLinkAbout1969-06-17; City Council; 9233; W/Harrison St. & Locust Ave. SP(I R .. \ . c c. 1 I ORDINANCE NO. 9233 2 3 4 5 6 7 0 9 10 11 12 13 14 15 16 17 18 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, ADOPTING A SPECIFIC PLAN OF PROPERTY LOCATED ON THE WESTERN SIDE OF HARRISON STREET, AT THE INTERSECTION WITH LOCUST AVENUE. The City Council of the City of Carlsbad, California, DOES ORDAIN that a Specific Plan for the hereinafter described real 4 property be adopted in the following particulars. SECTION 1. PROPERTY DESCRIPTION. That portion of Tract 238 of Thum Lands, Map 1681 in the City of Carlsbad, County of San Diego, State of California, being Parcels 8 and 9, Book 206, Page 112, 20 21 22 23 24 25 26 27 28 29 30 31 32 of the Assessoris Map of San Diego County, more particularly des- 1 cribed in application on file in the City Planning Office. SECTION 2. GENERAL CONDITIONS. The Specific Plan, marked Exhibit "A", attached hereto, entitled "Specific Plan for HOWARD HUCKS AND ASSOCIATES", is subject to the following conditions and restrictions: A. The development of the property described in Section 1 hereof shall be subject to the restrictions and limitations set forth herein which are in addition to all of the requirements, limitations and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force for the purpose of preserving the residential characteristics of adjacent properties. B. All public improvements shall be made in conformity with the Subdivision Ordinance and other City standards to the satisfaction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. C. All land and/or easements required by this ordinance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. That full subdivision improvements be constructed 10 1 2 3 4 5 '? 8 9 11 12 SECTION 3. PRIVATE DEVELOPMENT CONDITIONS. The following conditions shall apply with respect to any development after the effective date of this ordinance of the property described in Section 1 hereof: A. That the project be constructed with the density shown on the Specific Plan, and that the project be constructed in no less a manner than shown on the Specific Plan. (Exhibits A and B) B. That final elevation plans be subject to review by the Planning Department, and that the Mansard Roof treatment be con- tinued around (to a lesser extent) the structure. C. REQUIRED PUBLIC IMPROVEMENTS BEFORE ISSUANCE OF BUILDING PERMIT. The following shall be granted to the City of Carlsbad before any building permit will be issued for the development of the propert described in Section 1 hereof: A. C. A grading plan shall be submitted prior to the issuance ding permit. SECTION 5. ADMINISTRATION AND ENFORCEMENT. The Building Department shall not approve any building for occupancy until the Planning Director has certified that all the conditions of this ordinance have been satisfied. The Planning Director of the City of Carlsbad is designated as the enforcing officer of this Specific Plan. His decision shall be final as to whether the subject property has been properly developed and improved. However, the owners of the subject property may appeal to the City Council any decision of the Planning Director relative to this Specific Plan. Such appeal shall be in writing and filed with the City Clerk within 10 days following the receipt of the decision of the Planning Director. The City Council's decision shall be final. SECTION 6. EFFECTIVE DATE. This Ordinance shall be effective 30 days after its adoption. The City Clerk of the City of Carlsbad shall certify to the adoption of this Ordinance and cause it to be published once in the Carlsbad Journal within fifteen (15) days after its adoption.
