AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, ADOPTING A SPECIFIC PLAN OF PROPERTY LOCATED ON THE NORTHWEST CORNER OF ADAMS STREET AND CHINQUAPIN AVENUE.

A. The development of the property described in Section 1
hereof shall be subject to the restrictions and limitations set
forth herein which are in addition to all of the requirements,
limitations and restrictions of all municipal ordinances and
State and Federal statutes now in force, or which hereafter may
be in force for the purpose of preserving the residential

SECTION 1. PROPERTY DESCRIPTION. Easterly 100 feet of that
Portion of Tract 237 of Thum Lands Map 1681, in the City of Carlsbad
County of San Diego, State of California, being Parcel 3, Book 206
Page 5 of the Assessor's Map of San Diego County, and more
particularly described in application on file in the City Planning

characteristics of adjacent properties.
B. All public improvements shall be made in conformity
26ijwith the Subdivision Ordinance and other City standards to the
27ilsatisfaction of the City Engineer, without cost to the City of

shall be granted to the City of Carlsbad without cost to the

SECTION 3. PRIVATE DEVELOPMENT CONDITIONS. The following
conditions shall apply with respect to any development after the
effective date of this ordinance of the property described in
Section 1 hereof:
A. That the total density for subject parcel shall not exceed
eighty-five (85) units;
B. That final elevations shall be subject to review by the
Planning Department;
C. That a landscape and sprinkler plan for the setback areas
shall be submitted to the Planning Department for approval,
prior to construction; .
D. That a six-foot (6 ft.) hig wall or fence shall be
constructed along Adams Street.
E. That the building setback, along Adams Street, shall be
twenty (20) feet;
F. That a private yard fire hydrant shall be installed in
conformance with City Fire Department specifications and
direction.
@. That only one (1) driveway opening to Adams Street shall
be permitted:
H. That full street improvements, as required by the Subdivisio
Ordinance and the City Engineer, shall be installed along
the frontage of the property included in subject Specific Plan;
I. That the plans for this development shall be prepared by
a Registered Civil Engineer for the required Improvements;
J. Off-street. parking shall be as follows: Studio Apartment-
1 space; One-Bedroom - 1.25 spaces; Two-Bedroom - 1.50 spaces;
Three or more-bedroom - 2 spaces.
K. That the developer shall, prior to issuance of a Building
Permit, submit to the Planning Commission for their review and
approval, a development plan showing the locations of all proposed
apartment units and respective parking areas.

SECTION 4. REQUIRED PUBLIC IMPROVEMENTS BEFORE ISSUANCE
OF BUILDING PERMIT. The following shall be granted to the City
of Carlsbad before any building permit will be issued for the
development of the property described in Section 1 hereof:
A. All street improvements including water, sewer, under-
ground power and telephone, street tree planting, street light,

SECTION 5. The Building
Department shall not approve any hu

The Planning Director of the City of Carlsbad is designated
as the enforcing officer of this Specific lan. His decision shall
be final as to whether the subject property has been properly
developed and improved. However, the owners of the subject

shall be in writing and filed with the City Clerk within 10 days
following the receipt of the decision of the Planning Director.
The City Council's decision shall be final.
SECTION 6. EFFECTIVE DATE. This Ordinance shall be effective
30 days after its adoption.
Carlsbad shall certify to the adoption of this Ordinance and
cause it to be published once in the Carlsbad Journal within

INTRODUCED AND FIRST READ at a regular meeting of the City
Council of the City of Carlsbad, California, held on the 18th day
of November, 1969, and thereafter PASSED AND ADOPTED at a regular
meeting of said City Council on the 2nd day of December, 1969, by
the following vote, to wit:
