AN ORDINANCE OF THE CITY OF CARLSBAD, REPEALING ORDINANCE NO. 9182, AND ADOPTING A SPECIFIC PLAN FOR DAYTOM ENTERPRISES, INC., ON PROPERTY LOCATED ON SOUTH SIDE OF TAMARACK AVE. BETWEEN ADAMS STREET AND INTERSTATE 5. The City Council of the City of Carlsbad, California, DOES ORDAIN as follows: SECTION 1. ORDINANCE NO. 9182 REPEALED. Ordinance No. 9182 of the City of Carlsbad, adopting a site plan, is hereby repealed. SECTION 2. PROPERTY DESCRIPTION. That portion of Tract 237, Thum Lands Map 1681, in the City of Carlsbad, County of San Diego, State of California, being Parcel 13, Book 206, Page 050 of the Assessor's Map for San Diego County, and more particularly des- cribed in application on file in the office of the City Clerk. SECTION 3. GENERAL CONDITIONS. The Specific Plan, marked Exhibit "A", attached hereto, itled "Specific Plan for Daytom Enterprises, Inc." is subject to the following conditions and restrictions: A. The development of the property described in Section 2 hereof shall be subject to the restrictions and limitations set forth herein which are in addition to all of the requirements, limitations and restrictions of all municipal ordinances and State and Federal Statutes now in force, or which hereafter may be in force for the purpose of preserving the residential characteris- tics of adjacent properties. B. The following conditions shall apply with respect to any development after the effective date of this ordinance of the property described in section 1 hereof: 1. That the development shall exclude Building D, and shall be in conformance with the Specific Plan, Exhibit "A", as submitted by Daytom Enterprises, Inc. , and dated December 21 , 1970. 2. That the areas shown in GREEN on subject Exhibit "A" shall be planted in confromance with a plan prepared by a registered landscape architect and approved by the Planning Department. plan shall include trees, shrubs, flowers, groundcovers, sprinklers and a maintenance schedule designating the firm of persons re- sponsible for said maintenance. Such 24 25 18 19 20 21 26 3. Buildings A, B, and C shall be oriented towards Tamarack Avenue and away from adjacent residential uses to the South and East. Normal public access and excessive window openingsshall als be limited to the Tamarack Avenue side of the buildjngs. 27 28 does not compete with adjacent commercial uses, and because of the adjacent Residential uses, the signing shall be limited to wall 29 with the City of Carlsbad sign ordinance. 5. All exterior lighting fixtures and the parking lot illuminares shall be of an ornamental type, which will screen ad- jacent properties against flare from a direct light source. The facilities for storage of refuse and trash containers, for all stores and shops, shall be provided within the main struc- tures and shall not be visible from adjacent Residential areas. 8. A fire hydrant shall be installed adjacent to the South property line and in the vicinity of the loading area. Such in- stallation shall be as approved by the Fire Department. 10. The following conditions, as required by the Engineering Department, shall be developed in conformance with City Ordinances and as approved by the City Engineer: a. Full subdivision improvements as required by ordinance and the City Engineer shall be constructed on Adams Street and Tamarack Avenue. Additional right-of-way as required, shall be dedicated to the City. b. Improvement plans and grading and drainage plan shall be prepared by a gistered Civil Engineer and approved by the City Engineer ior to construction. c. A Parcel Map, in accordance with the Subdivision Map Act, shall be filed for the entire parcel. d. The applicant shall enter into a standard, bonded sub- division agreement, to guarantee construction of all public improvements. e.
