ORDINANCE NO. 9265
AN ORDINANCE OF THE CITY OF CARLSBAD ALLOWING TEMPORARY USE OF M ZONED PROPERTY FOR PORTABLE BATCH PLANT.
The City Council of the City of Carlsbad does ortain as
f olloras :
1, WHEREAS, expeditious completion of Interstate 5 is
necessary to the preservation of the peace, health and safety of
residents of Carlsbad,
2. WHEREAS, present City zoning does not permit said use,
and
3. WHEREAS, denial of this permit for a temporary use will
result in placement of the temporary Batch Plant on State pro-
perty in an undesirable location in central Carlsbad,
NOW, THEREFORE, the City Council does hereby ordain as an
urgency matter, that said plant will be permitted to locate and
operate on Parcel A of the attached map.
The Council does further ordain that all the terms and con-
ditions including but not limited to time and length of operatio]
of the plant as heretofore specified in the Planning Commission
submission and conditions of approval, will apply to the operatic
of said facilities.
This urgency ordinance shall in no way be construed to per-
mit a permanent operation on this or any other property in the
City of Carlsbad,
EFFECTIVE DATE: This ordinance shall take effect immedia-
tely.
PUBLICATION: The City Clerk of the City of Carlsbad is here
by directed to cause this ordinance to be published once in the
Carlsbad Journal, a newspaper published and of general circula-
tion in said City of Carlsbad.
