ORDINANCE NO. 9298
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD ADOPTING A SPECIFIC PLAN ON PROPERTY LOCATED ON THE NORTHWEST QUADRANT OF INTERSTATE-5 AND ELM AVENUE.

The City Council of the City of Carlsbad, California, DOES
6 ORDAIN that a Specific Plan for the hereinafter described real
7 property be adopted in the following particulars:
8 SECTION 1. PROPERTY DESCRIPTION. That portion of Tract No.
9 117 of Carlsbad Lands in the City of Carlsbad, County of San Diego,
10 State of California, according to Map thereof, No. 1661, filed in
11 the Office of the County Recorder of San Diego County, March 1, 1915,
12 more particularly described in application on file in the Office
13 of the City Clerk.
14 SECTION 2. GENERAL CONDITIONS. The Specific Plan, entitled
15 Exhibit "A", attached hereto, is subject to the following conditions
16 and restrictions:
17 A. The development of the property described in Section 1
18 hereof shall be subject to the restrictions and limitations set
19 forth herein which are in addition to all requirements, limitations
20 and restrictions of all municipal ordinances and State and Federal
21 statutes now in force, or which hereinafter may be in force for the
22 purpose of preserving the residential characteristics of adjacent
23 properties.
24 B. All public improvements shall be made in conformity with
25 the subdivision ordinance and other City standards to the satisfac-
261 tion of the City Engineer, without cost to the City of Carlsbad,
27 /I and free of all liens and encumbrances.
28 C. All land and/or easements required by this ordinance shall
29 be granted to the City of Carlsbad without cost to the City and
30 free of all liens and encumbrances.

D. No other use shall be allowed upon said property until
Specific Plans for it have been submitted and approved by the
:ity Planning Commission and the City Council.
SECTION 3. PRIVATE DEVELOPMENT CONDITIONS: The following
cond tions shall apply with respect to any development after the
effe tive date of this ordinance of the property described in
Section 1 hereof.
1. A functional internal circulation system that will benefit
both the proposed development and any future commercial development
to the west shall be submitted to the Planning Commission for revie
and approval by the City Engineer and the Planning Department.
a) The circulation system shall include but shall not be
restricted to the following:
1. Traffic at the easterly Elm Avenue entrance to
the development shall be restricted to ingress
only for westbound traffic and to right turns only
for traffic exiting the development.
2. Emergency ingress and egress shall be subject to
the approval of the City of Carlsbad Fire Chief.
2. Landscape and sprinkler system plans, including specifica-
tions for their construction shall be submitted to the Parks and
Recreation Director for approval prior to their installation and
prior to the issuance of an occupancy permit.
3. Schedules for maintenance, designating individual respons.
bilities for same shall also be submitted to the Parks and Recrea-
tian Director for approval prior to the issuance of an occupancy
permit.
4. The applicant shall provide a 3000 gallon per minute watei
flow at the easterly terminus of the Grand Avenue water line. All
Fire hydrants and Fire prevention devices shall be installed as
required by the City of Cqrlsbad Fire Chief.

5. The applicant shall enter into a future improvement
igreement for public improvements on Grand Avenue as outlined
ielow. Access rights to Grand Avenue shall be dedicated to the
:ity prior to the issuance of any permit for grading, building
ir occupancy. At such time as the adjoining properties to the
vest and north develop, the applicant may obtain access rights
to Grand Avenue provided the following improvements are accomplishe
a) The applicant shall increase Grand Avenue to a
minimum required right-of-way with suitable
traffic circulation and cul-de-sac provided.
b) The applicants shall construct full street
improvements including sidewalk, curb, gutter,
ornamental street lights and street trees on
those portions of Elm Avenue and Grand Avenue
that fall within the confines of the subject
development.
c) The applicants shall improve Grand Avenue from
the intersection of Hope Street to the easterly
terminus of Grand Avenue by constructing a
50-foot standard street section with A.C.
berm and a 50-foot radius cul-de-sac. Those
portions of Gra-d Avenue that abutt the pro-
posed development shall be permanently improved
as stated in condition 5b.
d) The applicants shall replace the existing 6-inch
sewer line in Grand Avenue with a suitable
sewer 1 i ne.
6. The development shall generally conform to the proposed
Speci fj c plan, "Exhi bi t A", "Scheme C" , any rev1 si ons shall be
subject to the review and approval of the Planning Department.

7. The elevations of structures and on-sit signing shown
on "Exhibit B" shall be adopted as a part of the overall specific
plan.
8. Every effort shall be made by the applicant and adjoining
property owners to coordinate circulation and architectural theme
so as to eliminate conflicting circulation patterns and architec-
tural treatments.
9. The location of all on-site signing shall be subject to
the approval of the traffic engineer to ensure maximum safety
of all entering or exiting vehicles.
10. All utilities shall be placed underground, no overhead
wires shal'l be permitted.
SECTION 4. REQUIRED PUBLIC IMPROVEMENTS BEFORE ISSUANCE OF
BUILDING PERMIT. The following shall be granted to the City of
Carlsbad before any building permit will be issued for the develop-
ment of the property described in Section 1 hereof;
A. All street improvements including water, sewer, undergroun
power and telephone, street tree planting, street light, storm
drain and any other improvements deedmed necessary by the City
Engineer shall be installed in conformance with City Standards
and indicated on an approved improvement plan prior to the issuance
of a building permit.
SECTION 5. ADMINISTRATION AND ENFORCEMENT. The Building
Department shall not approve any building for occupancy until the
Planning Director has certified that all the conditions of this
ordinance have been satisfied.
The Planning Director of the City of Carlsbad is designated
as the enforcing officer of this Specific Plan. His decision shall
be final as to whether the subject property has been properly
developed and improved. However, the owners of the subject propert

nay appeal to the City Council any decision of the Planning Direc-
tor relative to this Specific Plan. Such appeal shall be in writ-
ing and filed with the City Clerk within 10 days following the
receipt of the decision of the Planning Director. The City
Council's decision shall be final.
SECTION 5. EFFECTIVE DATE. This Ordinance shall be effective
30 days after its adoption. The City Clerk of the City of Carlsbad
shall certify to the adoption of this ordinance and cause it to be
published once in the Carlsbad Journal within fifteen (15) days
after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the City
Council of the City of Carlsbad, California, held on the 4th day
of April, 1972, and thereafter PASSED AND ADOPTED at a regular
meeting of said City Council on the 18th day of April, 1972, by
the following vote, to wit:
AYES: Cmn. Dunne, McComas, Jardine, Castro and Lewis.
NOES: None.
ABSENT: None.
