ORDINANCE NO. 9313 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, ADOPTING A SPECIFIC FACILITIES, INCLUDING ONE <I) MOTEL, ON PLAN FOR FREEWAY-ORIENTED COMMERCIAL PROPERTY LOCATED ON THE NORTHWEST QUAD- RANT OF INTERSTATE-5 AND ELM AVENUE. Joseph Parisi) The City Council of the City of Carlsbad, California DOES ORDAIN that a Specific Plan for the hereinafter described real property be adopted in the following particulars: SECTION 1. PROPERTY DESCRIPTION. That portion of Lot 31 in Schell and Sites addition to Carlsbad in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 1661, filed in the Office of the County Recorder of San Diego County, February 20, 1929, more particularly described in application on file in the City Planning Office. SECTION 2. GENERAL CONDITIONS. The Specific Plan, marked Exhibit "A", attached hereto, designated> -oriented commercial facilities, including one (1) motel, as prepared by Schoell , Geritz, Paul and A conditions A. hereof sha lard, Inc., Architects, is subject to the following and restri cti ons : The development of the property described in Section 1 1 be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and State and Federal Statutes now in force, or which hereafter may be in force for the purpose of preserving the residential character- istics of adjacent properties. B. All public improvements shall be made in conformity with the Subdivision Ordinance and other City standards to the satisfac- tion of the City Engineer, without cost to the City of Carlsbad and free of all liens and encumbrances. C. All land and/or easements required by this ordinance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. SECTION 3. PRIVATE DEVELOPMENT CONDITIONS: The following conditions shall apply with respect to any development after the effective date of this ordinance of the property described in Section 1 hereof: A. ExhSbit ''A" shall be adopted as the Specific Plan. Any deviation shall be subject to the approval of the Planning Department. B, Maximum effort shall be made to screen adjacent residential properties along the westerly boundary of the subject development. I C. A 6-foot high decorative block wall shall be placed on the westerly boundary from Grand Avenue to Laguna Drive. D. A driveway shall be placed between the northerly "Sandy's' Restaurant parking lot and the adjoining motel parking lot. E. A landscape and sprinkler plan shall be submitted to the Parks and Recreation Director and shall be subject to his approval prior to installation and prior to the issuance of an occupancy permit. .. F. A program for maintenance of the landscaping, and also designating those individuals responsible for same, shall be sub- mitted with the landscape plan and subject to the approval of the Parks and Recreation Director. G. An architectural concept, compatible with the design of Sandy's Restaurant and the new Standard Station facility, shall be subject to the approval of the Planning Department. H. Applicant shall file a Parcel Map in accordance with Subdivision Map Act. I. J. Applicant shall improve a cul-de-sac on Grand Avenue and enter into a future improvement agreement for the replacement of the existing sewer line in Grand Avenue. K. All right-of-way required for street improvements adjacent to the property shall be dedicated to the City free of all liens and encumbrances. L.
