The Specific Plan, marked xhi bi t "A" , attached hereto, entitled "Plan for Papagayo" (Hunts artnership), is subject to the following conditions and restriction A. PRIVATE DEVELOPMENT CONDITIONS. The following :onditions shall apply with respect to any development after the 2ffective date of this Ordinance of the property described in ;ection 1 hereof: 1. That all information required by City Ordinance No. Chapter 21.30 (Planned Community), be submitted for staff rev to final approval. A grading and drainage plan shall be approved by the City Engi neer prior to any grading. 7. All public improvements shall be constructed in accordance vith City of Carlsbad design criteria and shall be subject to the ipproval of the City Engineer. 8. The water distribution and sewer collection system shall )e dedicated to the City, together with the necessary easements,free 3f liens and encumbrances. Connections to the existing trunk line through the property shall be made only at manholes. 9. On-si te fire hydrants and fire protection appurtenances shall be constructed in accordance with Fire Department requirements. 10. The interior streets are proposed to be private. Installation of street improvements westerly of Jeffer- son Street may be deferred until construction is begun on that por- tion of the development west of the existing subdivision. 15. Fire retardant materials subject to the approval of the City Fire Chief shall be utilized wherever applicable. 16. That the developer will construct a decorative, six-foot high masonry block wall between the project and adjacent R-1 zone properties, the design and construction of which will be subject to the approval of the City Planning Department. Any other proposed fence designs will also be subject to the City Planning Department's approval. SECTION 4. REQUIRED PUBLIC IMPROVEMENTS BEFORE ISSUANCE OF A BUILDING PERMIT. The following shall be granted to the City of Carlsbad before any building permit will be issued for the develop- ment of the property described in Section 1 hereof: A. All street improvements including water, sewer4 under- ground power and telephone, street tree planting, street light, storm drain and any other improvements deemed necessary by the City Engineei shall be installed in conformance with City Standards and indicated 01 an approved improvement plan, or bond posted in lieu of improvements, prior to the issuance of a building permit. B. All lands necessary for street widening shall be dedicate( to the City of Carlsbad prior to approval of said improvement plan. C. A grading plan shall be submitted prior to the issuance of a building permit. SECTION 5. ADMINISTRATION AND ENFORCEMENT. The Building De- partment shall not approve any building for occupancy until the Plan- ning Director has certified that a11 the conditions of this Ordinance have been satisfied. -4- 4 5 SECTION 6. EFFECTIVE DATE. This Ordinance shall be effective thirty (30) days after its adoption. Carlsbad shall certify to the adoption of this Ordinance and cause it to be published once in the Carlsbad Journal within fifteen (15) days after its adoption.
