HomeMy WebLinkAbout1972-10-03; City Council; 4013; CMC 14.04.010 amend - Water regulations14 l! 2( 21 22 21 21 2: 2t 2‘ 2t . 2: 3( 3: ORDINANCE NO 401 3 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD AMENDING AND REPEALING PARTS OF TITLE 14, RESPECTING WATER REGULATIONSy OF THE CARLSBAD MUNICIPAL CODE(Amending Ordinance 4001 $2 and repealing parts of Ordinances 4001 through 4012) It is hereby ordained that: Section 14.04.010 of the Carlsbad Municipal Code is hereby amended to read as follows: (4) “Department” means the Public Works Department of the City; (10) “Stand by Charge” means the minimum monthly charge to a water consumer for availability of service , the revenue from which enables the City to maintain a water system ready to deliver water to a consumer. (11) “Dwelling Unit” means any single family or single person residential living unit which includes but is not limited to the following: houses, duplexes, apartments, condominiums, and mobile homes. (12) “Equivalent Dwelling Unit” means any unit designed for human use for commercial, industrial, or pro- fessional pnrposes which equals the water usage of an average dwelling unit, or which contains not more than the quantity of water using facilities (i. e. faucets, toilets, showers, outside outlets, etc. )as found in an average dwelling unit. time to time, administrative regulations providing guidelines for what constitutes usage of an average dwelling unit and the quantity of facilities of an average dwelling unit. The City Manager shall establish from (13) “’Ihdustri a Consumer-” mea surner using 20, 000 cu. ft. of water per month for the purpose of producing goods or services other than the services of housing, permanent or transient occupants. (14) “Institutional Consumer” means any institution devoted to housing aged, infirm, handicapped, or students as permanent occupants in single rooms or combinations thereof, and/or baths which do not constitute a dwelling unit by the above definition of dwelling unit, and in- cluding institutions described in any appropriate Council Resolution. 3, 2 3 4, 5 6 7 a 9 1c 11 3.2 1: 14 If le 1‘ 1i 1‘ 21 2. 2 2 2 2 2 2 2 2 3 3 5 All of Chapter 14. 12 entitled“Rates, Charges and Bil1ing”is hereby repealed, it being the intention of the City Council that all future regulations regarding rates, charges and billing shall be enacted by Resolution pursuant to authority set forth at Section 14. 04 030 of the Carlsbad Municipal Code. EFFECTIVE DATE: This ordinance shall take effect immediately because it is for the immediate preservation of the public peace, health and safety in that presently there is no ordinance in the City of Carlsbad restrict- ing the type of activity described in this ordinance, and it is necessary for the protection of the public health, safety and welfare that this ordinance be enacted immedia.tely . PUBLICATION: The City Clerk of the City of Carlsbad is hereby directed to cause this ordinance to be published once in the Carlsbad Journal, a newspaper published and of general circulation in said City of Carlsbad.
