ORDINANCE NO. 9334
AN ORDINANCE OF THE CITY OF CARLSBAD
ADOPTING A SPECIFIC PLAN GN PROPERTY LOCATED EAST OF JEFFERSON STREET AND NORTH OF THE PROPOSED MARRON ROAD. (Fawco)
The City Council of the City of Carlsbad, California, DOES
lRDAIN that a Specific Plan for the hereinafter described real pro-
ierty be adopted in the following particulars:
SECTION 1. PROPERTY DESCRIPTION. A parcel of land in the
:ity of Carlsbad, County of San Diego, State of California, being a
)ortion of Hosp Eucalyptus Forest Company's Tract according to map
;hereof No. 1136, filed in the Office of the County Recorder of said
lounty, June 8, 1908, and more particularly described in application
in file in the Office of the City Clerk.
SECTION 2. GENERAL CONDITIONS. The Specific Plan, entitled
Exhibit "A" attached hereto; is subject to the following conditions
and restrictions: _.
,1. The development of property described in Section 1 hereof
2: shall be subject to the restrictions and limitations set forth
herein which are in addition to all requirements, limitations and
restrictions of a1 1 muni ci pal ordi nances and State and Federal statu1
now in force, or which hereinaftef may be in force for the purpose
of preserving the residential characteristics of adjacent properties
2. All public improvements shall be made in conformity with
the subdivision ordinance and other City standards to the satisfac-
tion of the City Engineer, without cost to the City of Carlsbad, and
free of all liens and encumbrances.
3. All land and/or easements required by this Ordinance shal
be granted to the City of Carlsbad without cost to the City of Carls
and free of all liens and encumbrances.

4. No other use shall be allowed upon said property until
Specific Plans for it have been submitted and approved by the City
Planning Commission and City Council.

I 511 conditions shall apply with respect to any development after the

for building or grading and shall include at least the following:

BUILDING PERMIT. The following shall be granted to the City of
Carlsbad before any building permit will be issued for the develop-
ment of the property described in Section 1 hereof:
A. All street improvements including water, sewer, undergrounc
power and telephone, street tree planting, street light, storm drain

and any other improvements deemed necessary by the City Engineer
shall be installed in conformance with the City standards and indicated

b. Height, size and location of all signing
as permitted in the City of Carlsbad Sign Ordinance No. 9224.
c. Spatial relationships of all proposed buildings and structures as they relate to the existing portions of P1 aza Cami no Real .
d. Points of ingress and egress to the proposed shopping center from Marron Road and Jefferson Street shall be limited and shall be subject to the approval of the City Engineer.
e. An Environmental Impact Statement shall be submitted to the City of Carlsbad for review simultaneously with said Specific Plan applicqtion,
2. That a request for a General Plan Amendment shall be
submitted to the City of Carlsbad by October 13, 1972.
3. A hold harmless agreement shall be signed by applicant
and placed on file with the City of Carlsbad.

on an approved improvement plan, or bond posted in lieu of improve-
ments, prior to the issuance of a building permit.
B. All lands necessary for street widening shall be dedicatec
to the City of Carlsbad prior to approval of said improvement plan.
C. A grading plan shall be submitted prior to the issuance
of a building permit.
SECTION 5. ADMINISTRATION AND ENFORCEMENT. The Building
Department shall not approve any building for occupancy until the
Planning Director has certified that all the conditions of this
Ordinance have been satisfied.
INTRODUCED AND FIRST READ at an adjourned regular meeting of
the City Council held on the 30th day of October, 1972, and thereaft
PASSED AND ADOPTED at a regular meeting of said City Council held on
the 8th day of November, 1972, by the following vote, to wit:
AYES: Councilmen D'un.ne, McComas, Frazee and Chase
NOES: Councilman Lewis
ABSENT: None
