(Larwin Company) The City Council of the City of Carlsbad, California, DOES ORDAIN that a Specific Plan for the hereinafter described real Exhibit ''A" attached hereto, is subject to the following conditions and restrictions: i 1. The development of the property described in Section 1 property be adopted in the following particulars: 8 9 10 11 SECTION 1. PROPERTY DESCRIPTION. All that portion of Lot "J" in Rancho Agua Hedionda, in the County of San Diego, according to the partition map thereof No. 823 filed in the office of the County Recorder of said San Diego County on November 16, 1886, together with those portions of Lots 3, 4 and 5 in Section 32, Township 11 South, 12 13 Range 4 West, San Bernardino Meridian, according to United States 14 I Government Survey, approved December 27, 1870 and being located in 15 I ' ! aforementioned County, State of California, and being more particular1 described on file in the City Clerk's Office. le 17 18 I/ SECTION 2. GENERAL CONDITIONS. The Specific Plan, entitled I hereof shall be subject to the restrictions and limitations set forth 22 /I herein which are in addition to all requirements, limitations and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force for the purpose of preserving the residential characteristics of adjacent 23 24 25 26 f // properties. 27 2. All land and/or easements required by this ordinance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. 4. No other use shall be allowed upon said property until Specific Plans for it have been submitted and approved by the City Planning Commission and the City Council. 7l a/ effective date of this ordinance of the property described in SECTION 3. The sidewalks normally placed adjacent to the curb on dedicated streets shall be constructed in a meandering fashion and made a part of the pedestrial traffic system for the project. 5. Street improvements as required by ordinance shall be constructed in accordance with City standards, subject to the approval of the City Engineer, on all streets within the development and on Elm Avenue and Marron Road as required by Ordinance No. 9315. 14. The applicant shall enter into a secured agreement for the construction of full half street improvements on Elm Avenue from I' Street to the easterly limits of develo ,along the entire 15. The dedication of all a.11eys with the development shal SECTION 4. REQUIRED PUBLIC IMPROVEMENTS BEFORE ISSUANCE OF BUILDING PERMIT. The following shall be granted to the City of Carlsbad before any building permit will be issued for the development of the property described in Section 1 hereof: A. All street improvements including water, sewer, under- ground power and telephone, street tree planting, street light, storm drain and any other improvements deemed necessary by the City Engineer shall be installed in conformance with City Stand- ards and indicated on an approved improvement plan, or bond poste in lieu of improvements, prior to the issuance of a building perm B. All lands necessary for street widening shall be dedicated to the City of Carlsbad prior to approval of said improvement plan. C. A grading plan shall be submitted prior to the issuancl of a building permit. SECTION 5. ADMINISTRATION AND ENFORCEMENT. The Building Department shall not approve any building for occupancy until the Planning Director has certified that all the conditions of this ordinance have been satisfied. INTRODUCED AND FIRST READ at a regular meeting of the City Council held on the 19th day of December , 1972, and thereafte PASSED AND ADOPTED at a regular meeting of said City Council on the 2nd day of January , 1973, by the following vote, to wit: AYES : Councilmen Dunne, Chase, Lewis, Frazee.
