HomeMy WebLinkAbout1973-03-20; City Council; 9343; CMC 21 amends - R-A, R-1 & R-2 side yard setbacks revised1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 21 28 29 30 31 32 ORDINANCE NO. 9343 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING SECTION 21.08.040, 21.10.040 AND 21.12.040 OF THE CARLSBAD MUNICIPAL CODE PROVIDING FOR REVISIONS OF THE SIDE YARD SETBACKS DISTRICTS. APPLICABLE TO R-A, R-1 AND R-2 ZONING WHEREAS, pursuant to the provisions of Title 21 of the Carls. bad Municipal Code, the Planning Commission did on January 23, 1973, hold a duly advertised Public Hearing to consider the cer- tain amendment to8 the R-A, R-1 and R-2 Zoning Districts, as set out in Sections 21.08.040, 21.10.040, and 21.12.040 of the Carls- bad Municipal Code; and WHEREAS, the Planning Commission has made certain findings and has recommended that the City Council of the City of Carlsbad enact said amendments into law; and WHEREAS, the City Council of the City of Carlsbad has by Resolution No. 3058 adopted said findings as 'their own and ex- pressed their intent to amend the law in accord therewith; NOW, THEREFORE, BE IT ORDAINED, as follows: 1. Section 21.08.040 is amended to read as follows: "Section 21.08.040 Side Yards. In the R-A Zone every lot shall have side ards as follows: (a) Interior lots shall have the following side yards: (1) A side yard shall be provided on each side of the lot which side yard has a width equal to ten percent (10%) of the lot width; provided, that such side yard shall not be less than five feet in width and need not exceed ten feet. (2) The Director of Planning may approve a reduction in width of one side yard provided that the opposite side yard is in- creased in width by an amount equal to the reduction. The reduced side yard shall not be less than five feet in width nor shall it abut a lot or parcel of land with an adjacent reduced side yard, nor shall the increased side yard have a width of less than ten fe (3) In the event special circumstances ist, such as extreme topographical features and/or irregular shaped lots (such, ch front on cul-de-sacs) the Director of Planning may approve the application of a reduced side yard adjacent to a re- duced side yard, subject to the following condition: a. Section 21.10.040 is amended to read as follows: "Section 21.10.040 Side Yards. In the R-2 Zone every lot shall have side yards as follows: (a) Interior lots shall have the following side yards: (1) A side yard shall be provided on each side of the lot which side yard has a width equal to lot width; provided that such side yard shall not be less than five feet in width and need not exceed ten feet. (2) The Director of Planning may approve a reduction in width of one side yard provided that the opposite side yard i: increased in width by an amount equal to the reduction.
