AN QRDI'NANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING SECTIONS 8.09.011 AND 8.09.013 OF THE CARLSBAD MUNICIPAL CODE CHANGING THE MINIMUM SIZE OF DANCE FLOOR AND DISTANCE FROM BAR AREA.
The City Council of the City of Carlsbad, Cilifornia, does
ordain as follows:
SECTION 1: Section 8.09.011 of the Carlsbad Municipal
Code is amended to read as follows:
"8.09.011 Cabaret dance. "Cabaret dance"
means any dance conducted upon a floor contairjing
not less than one hundred square feet located in
the same room where alcoholic beverages are lawfully
sold for consumption upon the premises."
SECTION 2: Section 8.09.013 of the Carlsbad Municipal
Code is amended to read as follows:
"8.09.013 Cabaret dances--Requirements.
No person shall conduct, hold or engage in a cabaret
dance or cabaret dancing unless all of the following
conditions are at all times complied with:
fa) SIZE OF DANCE FLOOR: The dance floor shall
be a minimum size of one hundred square feet.
(b) DESIGNATION OF DANCE FLOOR: The dance floor
area shall be plainly marked and designated as a
dancing area. No dancing shall be permitted in the
premises except upon the dancing area thus marked and
designated.
(c) PERMIT RESTRICTIONS: During all hours during
which dancing is permitted by the permit issued hereunder
for the premises, no portion of the dancing area shall
be used for any purpose other than dancing and enter-
tainment,

[d) MAXIMUM NUMBER OF PATRONS: The maximum
number of persons, other than employees employed to
render help or service on the premises, shall not
at any one tlme exceed the number of permanent seats
provided equal to the quotient of the remaining square
floor area of usable floor space of the premises divided
by ftfteen. In computing usable floor area all portions
of the premises designed or intended primarily for the
use of or principally used by the employee of the premises,
and all exit passageways and corridors, shall be excluded.”
EFFECTIVE DATE: This ordinance shall be effective
thirty (30) days after its adoption and the City Clerk shall
certtfy to the adoption of this ordinance and cause it to be
published at least once in the Carlsbad Journal within fifteen
(15) days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 18thday - of September, 1973,
and thereafter PASSED AND ADOPTED at a regular meeting of
said City Council held on the 2nd day of October 9
1973, by the following vote, to wit:
AYES: Cmn. Dunne, McComas,. Lewis, Chase and Frazee.
NOES: None.
ABSENT: None.
