CE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING
TITLE 11, CHAPTER 11.08 OF THE CARLSBAD
MUNICIPAL CODE BY AMENDING SECTIONS
11.08.030 and 11.08.060 REGARDING
UNDERGROUND UTILITY DISTRICTS
The City Council of the City of Carlsbad does ordain as
follows:
SECTION 1 That Title 11, Chapter 11.08 of the Carlsbad
CJlunicipal Code be amended by amending Section 11.08.030 and
11.08.060 to read as follows:
Section 11.08.030 Desi,gnation of Underground Utility
Districts by Resolutian.
If, after any such public hearing the Council finds that
;he public health, safety, or welfare requires such removal and
such underground installation within a designated area, the Counci:
shall by resolution, declare such designated area an underground
itility district, and order such removal and underground instal-
Lation. Such resolution shall include a description of the area
:omprising such district and shall provide that the Council shall
'ix by subsequent resolution, the time within which such removal
ind underground installation shall be accomplished, having due
,egard for the availability of Labor, materials, and equipment
iecessary for such removal and for the installation of such under-
:round facilities as may be occasioned thereby.
Section 11.08.060 Other Ex.cepti0n.s. Any resolution adopted
ursuant to Section 11.08.030, shall not apply to any of the
ollowing types of facilities, unless otherwise provided for in
uch resolution;
(1) Any municipal facilities or equipment installed under
he supervision and to the satisfaction of the City Engineer;
(2) Poles, or electroliers used exclusively for street
ighting;

overhead. wipes and associated overhead structures

(4) Antennae, associated equipment and supportiag structures,
nsed by a utility for furnishing communication services;
(5) Equipment appurtenant to underground facilities, such as
surface mounted transformers, pedestal mounted terminal boxes and
neter cabinets, and concealed ducts;
(6) Temporary poles, overhead wires and associated overhead
structures used or to be used in conjunction with construction
iroj ects ;
(7) Overhead wires (exclusive of supporting structures)
:rossing any portion of a district within which overhead wires
lave been prohibited, or connecting to buildings on the perimeter
)f a District, when such wires originate in an area from which
ioles, overhead wires and associated overhead structures are not
Irohibited;
(8) Overhead wires attached to the exterior surface of a
Iuilding by means of a bracket or other fixture and extending
'rom one location on the building to another location on the same
)uilding OP to an adjacent building without crossing any public

(9) New or existing anchor poles and guy wires within the
listrick necessary to support overhead facilities outside the
Iistrict.
EFFECTIVE DATE, This ordinance shall be effective
;hirty (30) days after its adoption and the City Clerk shall
:ertify to the adoption of this ordinance and cause it to be
Iublished at least once in the Carlsbad Journal within fifteen
:15) days after its adoption.

INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 16th day of October, 1973,
and finally adopted and passed at a regular meeting of said
City Council held on the 7th day of November 9 1973, by the following vote, to wLt:
AYES :
NOES : None.
ABSENT: None.
