HomeMy WebLinkAbout1974-05-09; City Council; 8065; CMC 18.16 adopt by ref - Uniform Plumbing Code (1973 edition)ORDINANCE NO. 8065 AN ORDINA CE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 18, CHAPTER 18.16 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SEC- TIONS 18.16.010 THROUGH 18.16.120, IN- CLUSIVE AND BY THE ADDITION OF SECTIONS 18.16.130 THROUGH 18.16.230, INCLUSIVE, TO ADOPT BY REFERENCE THE 1973 UNIFORM PLUMBING CODE SUBJECT TO CERTAIN CHANGES, ADDITIONS AND AMENDMENTS AND TO ADOPT A PROCEDURE FOR ADMINISTERING SAID CODE. The City Council of the City of Carlsbad, California does ordain as follows: SECTION I: That Title 18, Chapter 18.16 of the Carlsbad Municipal Code is amended by the amendment of Sections 18.16.010 through 18.16.120, inclusive to read as follows: IrI GENERAL REGULATIONS edition of the Uniform Plumbing Code copyrighted by the Interna- tional Association of Plumbing and Mechanical Officials is hereby adopted by reference as the Plumbing Code of the City of Carlsbad except for the changes, additions and amendments set forth in this chapter which shall supersede the provisions of said code. "18.16.010 Adoption of Uniform Plumbing Code. The 1973 18.16.020 Application and Scope. The provisions of this code shall apply to all the new construction, relocated buildings, and to any alterations, repairs, or reconstruction, except as provided for otherwise in this code. 18.16.030 Administrative Authority and Assistants. When- ever the term "administrative authority" is used in this code it shall be construed to mean the Director of Building and Housing or his authorized representatives. 18.16.040 Department Having Jurisdiction. Unless otherwise provided by law, the office of the administrative authority shall be a part of the Building and Housing Department 18.16.050 Duties of the Administrative Authority. The administrative authority shall maintain public office hours necessary to efficiently administer the provisions of this code and amendments thereto and shall perform the following duties: 1. Require submission of, examine and check plans and specifications, drawings, descriptions and/or diagrams necessary to show clearly the character, kind and extent of plumbing work covered by applications for a permit and upon approval thereof shall issue the permit applied for. Nothing herein shall prevent the building official from making microfilm copies of said plans, specifications and permits and retaining said microfilm copies in lieu of the plans, specifications and permits. Administer and enforce the provisions of this code in a manner consistent with the intent thereof and shall inspect all plumbing and drainage work authorized by any permit to assure compliance with provisions of this code or amendments thereto, approving or condemning said work in whole or in part as condi- tions require. 3. Issue upon request a Certificate of Approval for any work approved by him. 4. Condemn and reject all work done or being done or materials used or being used which do not in all respects comply with the provisions of this code and amendments thereto. 5. Order changes in workmanship and/or materials essen- tial to obtain compliance with all provisions of this code. 6. Investigate any construction or work regulated by this code and issue such notices and orders as required. 7. Keep a complete record of all the essential transac- tions of his office for a period of two years. 8. Insure that all fees required by this chapter are collected by and transferred to the proper authority provided by law. 18.16.060 Authority of Administrative Authority. The administrative authority shall carry proper cred- entials and have the right during reasonable hours, or at any time when extreme danger exists, to enter any building in the discharge of their official duties or for the purpose of making an inspec- tion, reinspection, or test of the plumbing installations, devices, fixtures, appliances and equipment contained therein. The admin- istrative authority shall have the authority to cut or disconnect any such installation, in case of emergency, where necessary for safety of life or property, or where such installations may inter- fere with the work of fire fighting forces. authority is hereby authorized to disconnect or(0orderdiscontinu- ance or removal of plumbing installations, fixtures, devices, applicances, or equipment found to be dangerous to life or property because they are defective or defectively installed. The administrative 18.16.070 Violations and Penalties. Any person, firm or corporation violating any of the provisions of this code shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not less than $5 nor more than $500, or by imprisonment in the County Jail for not to exceed six months, or by both such fine and imprisonment. Each separate day or any portion thereof during which any violations of this code occurs or continues shall be deemed to constitute a separate offense, and upon conviction thereof shall be punishable as herein provided. The issuance or granting of a permit or approval of plans shall not prevent the administrative authority from thereafter requiring the correction of errors in said plans and specifica- tions or from preventing construction operations being carried on thereunder when in violations of this code or of any other ordi- nance or from revoking any Certificate of Approval when issued in error. 18.16.080 Permit Required. 2. It shall be unlawful for any person to install, remove, alter, repair or replace or cause to be installed, removed, al- tered, repaired or replaced any plumbing, gas or drainage piping work or any fixture or water heating or treating equipment in a building or premises without first obtaining a permit to do such work from the administrative authority. 2. A separate permit shall be obtained for each building or structure except separate permits shall not be required for a dwelling or duplex and auxiliary buildings or structures on the same property providing such auxiliary buildings or structures are being constructed simultaneously with the dwelling or duplex. 18.16.090 Expiration of Permit. Every permit issued by the administrative authority under the provisions of this code shall expire by limitation and become null and void, if the work authorized by such permit is not commenced within 120 days from date of such permit, or if the work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 120 days. Before such work can be recommenced, a new permit shall first be obtained, and the fee therefor shall be one-half the amount required for a new permit for such work pro- vided no changes have been made, or will be made, in the original plans and specifications for such work, and provided, further, that such suspension or abandonment has not exceeded one year. Within the overall one-year life of a permit any failure to com- mence work or anysuspension of work caused solely by delay inci- dent to securing approval from the California Coastal Zone Con- servation Commission pursuant to Division 18 of the Public Re- sources Code shall not constitute part of the respective 120-day periods presented for expiration of a permit. 18.16.100 Work Not Requiring Permit. No permit shall be required in the case of any repair work as follows: The stopping of leaks in drains, soil, waste or vent pipe, provided, however, that should any trap, drainpipe,. soil, waste or vent pipe be or become defective and it becomes necessary to remove and replace the same with new material in any part or parts, the same shall be considered as such new work and a permit shall be procured and inspection made as hereinbefore provided. No permit shall be required for the clearing or stoppages or the repairing of leaks in pipes, valves or fixtures, when such repairs do not involve or require the replacement or rearrangement of valves, pipes, or fix- tures. 18.16.110 To Whom Permit May Be Issued. A permit may be issued to any person not acting in violation of any current con- tractor licensing law. 18.16.120 Application for Permit. Any person legally entitled to apply for and receive a permit shall make such appli- cation on forms provided for that purpose. He shall give a des- cription of the character of the work proposed to be done, and the location, ownership, occupancy and use of the premises in connection therewith. The administrative authority may require plans, specifications or drawings and such other information as he may deem necessary. If the administrative authority determines that the plans, specifications, drawings, descriptions or information furnished by the applicant is in compliance with this code, he shall issue the permit applied for upon payment of the required fee as here- inaf ter fixed. " 3. 11 1: 1; 1: 2: 2: 2; 24 2: 2t 2'; 2E 2s 3c 33 32 SECTION 2: Title 18, Chapter 18.16 of the Municipal is amended by the addition of Sections 18.16.130 through 18. inclusive, to read as follows: Code 6.180 "18.16.130 Cost of Permit. Every applicant for a permit to do work regulated by this code shall state in writing on the application form provided for that purpose, the character of work proposed to be done and such information pertinent thereto as may be required, Such applicant shall pay for each permit issued at the time of issuance a fee in accordance with the following schedule, and at the rate provided for each classification shown herein. Any person who shall commence any work for which a permit is required by this code without first having obtained a permit therefor shall, if subsequently permitted to obtain a permit, pay double the permit fee fixed by this section for such work, pro- vided, however, that this provision shall not apply to emergency work when it shall be proved to the satisfaction of the adminis- trative authority that such work was urgently necessary and that it was not practical to obtain a permit therefor before the com- mencement of the work. In all such cases a permit must be obtainec as soon as it is practical to do so, and if there be an unreason- able delay in obtaining such permit, a double fee as herein provid- ed shall be charged. For the purpose of this section a sanitary plumbing out- let on or to which a plumbing fixture or appliance may be set or attached shall be construed to be a fixture. Fees for reconnec- tion and retest of existing plumbing systems in relocated build- ings shall be based on the number of plumbing fixtures, gas system! water heaters, etc., involved. For factory-built housing no fixture or water heater fee shall be charged for those fixtures and water heaters installec at the factory when the structure has been manufactured in accord- ance with the State of California Factory-Built Housing Law. It shall be the duty of the person doing the work authorized by the permit to notify the administrative authority orally or in writing that said work is ready for inspection. than 24 hours before the work is to be inspected. A reinspection fee may be assessed for each inspection or reinspection when such portion Df work for which inspection is called is not complete.- This section is not to be interpreted as requiring rein- spection fees the first time a job is rejected for failure to zomply with the requirements of this code, but as controlling the practice of calling for inspections before the job is ready for such inspection or reinspection. Reinspection fees may be assessed when it is apparent to the administrative authority that the inspector is being used to provide supervision of the work rather than for the performance Df his proper inspection duties. Reinspection fees may be assessed when the permit card is not properly posted on the work site or the approved plans are not readily available to the inspector. To obtain a reinspection the applicant shall file an ipplication therefor in writing upon a form furnished for that mrpose, and pay the reinspection fee in accordance with the Sched- Ile of Fees. 5. 2c 21 22 22 24 25 26 27 28 29 30 33. 32 h 0 In instances where reinspection fees have been assessed no additional inspection of the work will be performed until the required fees have been paid. 18.16.170 Standards for Installation and Materials. All installations and materials shall be in conformity with the pro- visions of this code and with approved standards of safety as to life and property. All installations on any public or private piers or on the tidelands shall be in conformity with the pro- visions of this code. with the approval of the Director of Public Health. The disposal of the effluent must meet 18.16.180 New Permit Required Where Another Plumber Completes Work. When one contracting plumber obtains a plumbing permit and completes the rough work in whole or in part on any plumbing job, and a second contracting plumber is called upon to complete said plumbing work in whole or in part, a separate per- mit shall be obtained by the said second contracting plumber for which the full fee shall be charged. holding a permit for the installation of such work shall be held responsible only for the work he installed." SECTION 3: That Title 18, Chapter 18.16 of the Carlsbad Each contracting plumber Municipal Code is amended by the addition of Sections 18.16.190 through 18.16.220, inclusive, to read as follows: I' I I MODIFICATIONS "18.16.190 Section 313 Amended--Deviations. Section 313 of the Uniform Plumbing Code is hereby amended by the addition of a second paragraph to the exception to read: 'The administrative authority may grant deviations from the provisions of this section for condominiums, planned unit developments, apartment complexes, schools, governmental agencies, churches or commercial and industrial complexes, and accessory buildings, provided the property is under single ownership.' 18.16.200 Section 409(a) Amended--Backwater Valve. Sec- tion 409(a) of the Uniform Plumbing Code is amended to read as follows: '(a) In drainage piping an approved backwater valve may be installed for protection against the back flow of sewage.' 18.16.210 Section 912 Added--Toilet Room Requirements. Section 912 is hereby added to the Uniform Plumbing Code to read a6 follows: 'Section 912: Toilet Room Requirements. The entrance for such restrooms shall open on a common accessway.' 18.16.220 Standards. The plumbing standards both product and installation shall be a part of the Plumbing Code for the ~ City of Carlsbad." EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adop- tion.
