ORDINANCE NO, 9398
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ADOPTING
A SPECIFIC PLAN (SP-131) FOR A 420-UNIT
RESIDENTIAL DEVELOPMENT ON PROPERTY
GENERALLY LOCATED NORTHERLY OF AND
ADJACENT TO OLIVENHAIN ROAD APPROXIMATELY
2,080 FEET EASTERLY OF THE INTERSECTION
OF OLIVENHAIN ROAD AND EL CAMINO REAL,
APPLICANT: PONDEROSA HOMES (KAISER-AETNA)
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: A Specific Plan (SP-131) is hereby adopted
for a 420-unit residential development on property generally
located northerly of and adjacent to Olivenhain Road approximately
2,080 feet easterly of the intersection of Olivenhain Road and El
Camino Real, more particularly described as:
Thatportion of Lot 11 of Rancho Las Enchitas,
according to Map No. 848 thereof filed in the
office of the County Recorder of the County of
San Diego, State of California, June 27, 1898,
said plan to consist of a plot plan marked Exhibit A to SP-131
(revised, dated January 22, 1974) and an application with attach-
ments on file in the office of the City Planning Department and
incorporated by reference herein, subject to all terms and condi-
tions of this ordinance.
SECTION 2: Findings. The approval of Specific Plan
(SP-131) is justified by the following findings:
A. Conformance of the revised Specific Plan to the
spproved Master Plan No. 105.
B. Conformance of the revised Specific Plan to all re-
Juirements of the Municipal Ordinance for property located in the
Planning Community Zone District.
C. Conformance of the precise development to the existing
snd proposed development in the area, -
SECTION 3: Development Conditions. The Specific Plan
(SP-131) is approved subject to the following conditions and

restrictions and the development of the property, as described in
Section 1 hereof, shall be subject to all such conditions and
restrictions which are in addition to all requirements, limita-
tions and restrictions of all municipal ordinances and state and
federal laws now in force or which may hereafter be in force:
A. The approval of this Specific Plan is granted for
the land described in application and any attachments
thereto and as shown on the plot plan submitted labeled Exhibit A. The location of all buildings, fences, signs,
roadways, parking areas, landscaping and other facilities
or features shall be located substantially as shown on the
plot plan labeled Exhibit A, except or unless indicated
otherwise herein.
B. Unless the construction of the structure or facil- ity is commenced not later than one year after the date
the approval is granted and is diligently pursued there-
after, this approval will automatically become null and
void.
C.
Director. of an application for an amendment to be considered by
the Planning Commission.
Any minor change may be approved by the Planning
Any substantial change will require the filing
D. All requirements of any law, ordinance or regula- tion of the State of California, City of Carlsbad, and any
other governmental entity shall be complied with.
E. Prior to obtaining a building permit and within 30
days hereof the applicant shall file with the Secretary of the Planning Commission written acceptance of the condi- tions stated herein.
F. Compliance with and execution of all conditions listed hereon shall be necessary,unless otherwise specifiec
prior to obtaining final building inspection clearance.
Deviation from this requirement shall be permitted only
by written consent of the Planning Director.
G. A detailed landscape and sprinkler plan prepared
by a landscape architect shall be submitted to the Planninc
Director for consideration and approval. This requirement
shall apply to all the private park areas, open space areas, the proposed meandering sidewalk and proposed en- trance medians. Said plan shall also include the detailed plans for the proposed recreation facilities to be in-
stalled in the private park areas.
H. Prior to final building inspection clearance for
each phaseall, landscaping and recreational facilities
shall be installed. Said landscaping shall at all times
be maintained in a manner acceptable to the Planning
Director.
I. Prior to any construction the applicant shall submit plans to the appropriate entity providing domestic water to the proposed development for its approval of the

location, type and adequacy of water lines and to this
Fire Department for approval of the location of fire
hydrants.
J. The applicant shall establish and hereafter main-
tain a homeowner's association for the purpose of main-
taining the private park areas,
SECTION 4: Administration and Enforcement. The Building
Department shall not approve any building for occupancy until the
Flanning Director has certified that all the conditions of this
Drdinance have been satisfied.
EFFECTIVE DATE: This ordinance shall be effective thirty
3ays after its adoption, and the City Clerk shall certify to the
sdoption of this ordinance and cause it to be published at least
Dnce in the Carlsbad Journal within fifteen days after its adop-
tion.
INTRODUCED AND FIRST READ at a regular meeting of the
Zarlsbad City Council held on the 2nd day of July , 1974,
and thereafter PASSED AND ADOPTED at a regular meeting of said
Zouncil held on the 16th day of July , 1974, by the follow-
ing vote, to wit:
AYES: Councilmen Frazee, Chase, McComas and Lewis.
NOES: None.
ABSENT : None.
ABSTAINED: Councilman Skotnicki
