(N/Lowder Ln - PAR & N/Camino Del Parque) 201-unit condo SPP 1 2 3 4 5 6 7 a 9 10 11 12 13 20 21 22 23 24 25 26 27 28 29 30 33 32 k V ORDINANCE NO. 9407 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING A SPECIFIC PLAN (SP-161) FOR 201 CONDOMINIUM UNITS ON 37.5 ACRES GENERALLY LOCATED ON THE NORTH SIDE OF LOWDER LANE BETWEEN PALOMAR AIRPORT ROAD AND THE NORTHERLY TERMINUS OF CAMINO DEL PARQUE. APPLICANT: PACIFIC POINT DEVELOPMENT CO. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: A Specific Plan (SP-161) is hereby adopted for 201 condominium units on 37.5 acres generally located on the north side of Lowder Lane between Palomar Airport Road and the northerly terminus of Camino del Parque, more particularly de- scribed as: A portion of Lot H of the Rancho Agua Hedionda in the City of Carlsbad, County of San Diego, State of California, according to Map No. 823 on file in the office of the County Recorder, San Diego County, and further described as: Parcel B of Parcel Split No. 140-A on file in the office of the City Engineer, City of Carlsbad, said plan to consist of a plot plan marked Exhibit A to SP-161, an( an application with attachments on file in the office of the City Planning Department and incorporated by reference herein, subject to all terms and conditions of this ordinance. SECTION 2: Findings. The approval of Specific Plan (SP-161) is justified by the following findings: A. Conformance of the revised Specific Plan to the approved Master Plan and to the General Plan. B. Conformance of the revised Specific Plan to all re- quirements of the Municipal Code requirements applicable to prop- erty located in the Planned Community Zone. C. The Specific Plan ) is approved subject to the following conditions and restrictions and the development of the property, as described in Section 1 hereof, shall be subject to all such conditions and restrictions which are in addition to all requirements, limita- tions and restrictions of all municipal ordinances and state and federal laws now in force or which may hereafter be in force: 1. The approval is granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A. The lccation of all buildings, fences, signs, roadways, park- ing areas, landscaping, and other facilities or features shall be located substantially as shown on the plot plan labeled Exhibit A, except or unless indicated otherwise herein. All buildings and structures shall be of the design as shown on the elevation plans labeled Exhibit B. 2. Any minor change may be approved by the Planning Director. Any substantial change will require the filing of an application for an amendment to be considered by the Planning Commission. 3. All requirements of any law, ordinance or regula- tion of the State of California, City of Carlsbad, and any other governmental entity shall be complied with. 4. The project shall be generally phased as follows: Phase 1 - March 1, 1975 Phase 2 - September 1, 1975 Phase 3 - February 1, 1976 Phase 4 - October 1, 1976 Phase 5 - January 1, 1977 This approval shall be null and void if construction is not commenced on the final phase five years from the date of this approval. 5. All utilities including electrical, telephone and cable television shall be installed underground and/or shall be completely concealed from view. 6. A detailed landscape and sprinkler plan prepared by a landscape architect shall be submitted to the Parks and Recreation Department. 7. Prior to occupancy the applicant shall submit plans to the appropriate entity providing domestic water to the proposed development for its approval of the location, type and adequacy of water lines and to this Fire Department for approval of the location of fire hydrants. 8. Prior to occupancy of each phase, all landscaping shall be installed. Said landscaping shall at all times be maintained in a manner acceptable to the Planning Director. 10. On-street parking and traffic control shall be enforced pursuant to the California Vehicle Code. The applicant shall acknowledge his concurrence in wri-ting prior to approval of the final map for CT 74-17. 11. No permits, final map approvals or other entitle- ments will be granted or issued by the City of Carlsbad until any necessary California Coastal Zone permits have been issued. SECTION 4: Administration and Enforcement. The Building Department shall not approve any building for occupancy until the Planning Director has certified that all the conditions of this ordinance have been satisfied. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the 6th day of November , 1974, and thereafter I,. PASSED AND ADOPTED at a regular meeting of said Council held on the 19th day of November , 1974, by the following vote, to wit: -- AYES: Councilmen Frazee, Chase and McComas.
