HomeMy WebLinkAbout1975-06-10; City Council; 5045; CMC 6.02.010(c) add - Food establishments annual inspection fees1 2 3 4 5 6 7 8 9 10 11 12 1: 14 If 1t 17 I€ 1s 2c 23 22 22 24 25 26 27 28 29 ORDINANCE NO. 5045 AN RDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 6, CHAPTER 6.02 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION 6.02.010 WHICH INCORPORATES CERTAIN PORTIONS OF THE SAN DIEGO COUNTY CODE OF REGULATORY ORDINANCES RELATING TO HEALTH AND SANITATION TO REVISE THE ANNUAL INSPECTION FEES FOR FOOD ESTABLISHMENTS. The City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: Title 6, Chapter 6.02, Section 6.02.010 of the Carlsbad Municipal Code is amended by the addition of sub- section (c) to read as follows: “(c) Section 61.116 of the San Diego Code of Regulatory Ordinances adopted by reference by this section is amended to read as follows: ‘Sec. 61.116. ANNUAL INSPECTION FEE. Every person applying for a permit under the provisions of this division shall at the time of making application for the permit pay the follow- ing annual inspection fees: 1. For each establishment, other than a vehicle or vend- ing machine, a fee based on the average number of employees during the preceding year or, if in the opinion of the Health Officer said average number does not reflect the number of employees during the year for which the permit is sought with reasonable accuracy, the estimated average number of employees. 1 to 10 employees $30.00 11 to 99 employees 3.00 per employee 100 or more employees 300.00 2. For one or two vehicles under the same ownership 3. For each vending machine dispensing milk, ice cream, or milk products or other kinds of perishable foods or beverages, or dis- pensing unbottled or uncanned liquid foods or beverages, excepting vending machines which dispense unwrapped nonperishable, non-liquid food products $6.00 5. For each duplicate permit replacing a permit previously issued $6.00 In any case where the applicant has failed for a period of 30 days to file the application and obtain the permit required by this chapter, there shall be added to and collected with the inspection fee a penalty equal to 10% of the fee or $1.00, which- ever is the greater, and for each additional month or fraction of a month after the expiration of said 30-day period that the appli- cant fails to file such application and obtain such permit, there shall be added to and collected with the inspection fee an addi- tional penalty equal to 10% of the inspection fee, provided, however, in no event shall the total penalty added to the inspec- tion fee pursuant to this section be more than 60% of the inspec- tion fee. this section shall not prevent the imposition of any other penalty prescribed by this chapter or a criminal prosecution for violation of this chapter. ments and taxation are exempt from paying the fees established by this division.
