ORDINANCE NO. 9428
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AMENDING
TITLE 21, CHAPTER 21.54 OF THE CARLSBAD
MUNICIPAL CODE BY THE AMENDMENT OF SECTION
21.54.060 TO REVISE THE NOTICE PROCEDURES
FOR PUBLIC HEARINGS.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: Title 21, Chapter 21.54 of the:Xarlsbad
Municipal Code is amended by the amendment of Section 21.54.060
to read as follows:
"21.54.060 Notices. Notice of the time and place of public hearings shall be qiven in the followins manner: ~
(1) Notice of any public hearing upon-a proposed amend- ment to this title, a preannexation zoning, zoning or rezoning of
any property, a variance or conditional use permit, a tentative
subdivision map or any other matter required to be heard by the
Planning Commission or City Council by state law or this code whick
do not contain particular notice requirements shall be published at least once in a newspaper of general circulation published
and circulated in the city not less than ten days before the date of the public hearing.
(2) Notice of any public hearing to consider a variance or conditional use permit, a zoning ordinance or an amendment to
a zoning ordinance which changes any property from one zone to
another or imposes any regulation pursuant to Section 65850 of
the Government Code not theretofore imposed, or removes or modi-
fies any such regulation theretofore imposed shall be given by
mailing a written notice to all persons, including businesses,
corporations or other public or private entities owning real prop-
erty within 300 feet of the exterior boundaries of the property
which is the subject of the public hearing, such notice to be
mailed not less than ten days before the date of the public hear-
ing, to the last known name and address of such owners as shown
on the last equalized assessment roll. Such mailed notice shall
not be required where the amendment to this title changes any
general regulation applicable to all the property in any one zone."
EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 3rd day of June , 1975,
and thereafter
PASSED AND ADOPTED at a regular meeting of said Council
held on the 17th day of June , 1975, by the following vote,
to wit:
