(N/Agua Hedionda Lagoon) 156 dwelling units SP1 2 3 4 5 6 7 8 9 10 11 12 13 14 9 v 20 21 22 22 24 25 26 27 28 29 z - o ORDINANCE NO. 9429 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING A SPECIFIC PLAN (SP-168) TO ALLOW DEVELOP- MENT OF 156 DWELLING UNITS ON AN 8-ACRE PIECE OF LAND LOCATED ON THE NORTH SHORE OF THE AGUA HEDIONDA LAGOON. APPLICANT: RACA DEVELOPMENT COMPANY. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: A Specific Plan (SP-168) is hereby adopted to allow development of 156 dwelling units on an 8-acre piece of land located on the north shore of the Agua Hedionda Lagoon, more particularly described as: That parcel of land lying in Lot "I", Rancho Agua Hedionda, City of Carlsbad, according to Map thereof No. 823, as recorded in the office of the San Diego County Recorder, December 15, 1896, said plan to consist of a plot plan marked Exhibit A to SP-168, dated March 14, 1975, and an application with attachments on file in the office of the City Planning Department and incorporated by reference herein, subject to all terms and conditions of this ordinance. SECTION 2: Findings. The approval of Specific Plan (SP-168) is justified by the following findings: 1. The adverse environmental impacts of the project have been mitigated in the following manner: (a) Visual access to the lagoon has been preserve< through project design. (b) Physical access to the lagoon is ensured through provision of three public walkways. 20 21 22 23 24 25 26 27 28 t 0 (c) Siltation of the Lagoon will be controlled through prohibition of grading during rainy months and planting of erosion control vegetation at the earliest possible date. 2. The project meets all standards for uses in the Planned Community Zone. 3. The project complies with the General Plan in the following manner: (a) It complies with the density requirements of the Land Use Element. (b) It preserves the scenic and recreational amenities of the lagoon as required by the Open Space and Conservation Elements. (c) It provides for a bicycle corridor and pre- servation of scenic vistas along Park Drive as required by the preliminary Scenic Highways and Circulation Ele- ments. 4. The project has been assured the availability of public facilities by the City Engineer and Carlsbad Uni- fied School District. SECTION 3: Development Conditions. The Specific Plan (SP-168) is approved subject to the following conditions and restrictions, and the development of the property, as described in Section 1 hereof, shall be subject to all such conditions and restrictions which are in addition to all requirements, limita- tions and restrictions of all municipal ordinances and state and federal laws now in force or which may hereafter be in force: (a) The approval is granted for land described in the ... ... ... ... 2. application and any attachments thereto, and as shown on the plot plan, labeled Exhibit A, the elevations labeled Exhibit B, the garage plan labeled Exhibit C and the floor plan labeled Exhibit D, all of which are dated March 14, 1975. All buildings, roadways, landscaping, parking, building sitings and other features shall sub- stantially conform to these exhibits. (b) Unless a final subdivision map is recorded for the project within four-and-one-half years of this approval, the Specific Plan shall become null and void. (c) All requirements of any law, ordinance or regulation of the State of California, City of Carlsbad, and any other governmental entity shall be complied with. (d) Any mechanical and/or electrical equipment to be located on the roof of the structure shall be screened in a manner acceptable to the Planning Director. Detailed plans for said screening shall be submitted, in triplicate, to the Planning Director. (e) A detailed landscape and sprinkler plan pre- pared by a landscape architect shall be submitted to the Parks and Recreation Director for consideration and approv- al. (f) All utilities, including electrical, telephone and cable television, shall be installed underground and/oi shall be completely concealed from view. (9) Any phasing of this project shall require an amendment to this Specific Plan. (h) The applicant shall install permanent bicycle parking facilities at the termini of Marina Drive and the cul-de-sac on the east side of the property. Said facili- ties shall meet the specifications of the Parks and Recrea- tion Director and the City Engineer. (i) Driveways shall have a 24-foot clear width. Minimum width of paving at parking areas shall be 44 or 64 feet (one or two 20-foot stalls, plus 24-foot aisles). Parking at the top of garage ramps is not allowed. (j) Adequate facilities, clearances and maneuver- ability for trash removal and emergency vehicles shall be provided. (k) All structures shall observe a 35-foot height limit as defined by the Uniform Building Code, with the 1 2 2 c 4 5 6 7 8 9 1c 11 1% 13 n 14 20 - u 21 22 23 24 25 26 27 28 29 exception of the eight "loft areas" whose location is depicted on the plot plan, Exhibit A, and whose dimen- sions shall conform to those shown on the elevations, Exhibit B. In no case shall the "loft areas" measure more than 41 feet in height, as defined by the Uniform Building Code. (1) Adequate fire protection shall be ensured through a combination of fire resistant building design materials and construction of water mains and hydrants. This shall be accomplished in a manner acceptable to the Building Department. (m) The applicant shall submit for review and approval by the Planning Director a plan for recreational facilities on the site prior to the issuance of building permits. The recreation plan shall include a recrea- tion area for children. All recreational structures and appurtenant facilities shall be placed so that they do not obscure the view of the lagoon. (n) Prior to issuance of a grading permit, the applicant shall submit for the City Engineer's review and approval a detailed soils study prepared by a qualified soils engineer. This study shall: (1) Determine the soil stability and height of the water table over the entire property. (2) Recommend any engineering solutions necessary to stabilize structures and prevent flooding of the subterranean garages. (0) Right-of-way shall be dedicated to provide a 42-foot half street section for Park Drive and public frontage improvements shall be constructed as required by the City Engineer. Rights of access to Park Drive shall be waived. A pedestrian way and separate public bikeway shall be provided within the 10-foot parkway and 15-foot building setback. (p) Right-of-way shall be dedicated and public frontage improvements shall be constructed along Marina Drive to provide a 40-foot curb-to-curb dimension, plus a 7-foot parkway. The intersection of Park Drive and Marina Drive shall be realigned to avoid acute turning movements and to provide a free right-turn movement onto Park Drive, in accordance with City standards. A 15-foot easement and improved walkway from Marina Drive to the lagoon shall be dedicated. 4. All public walkways on the project shall be lighted and barred to motor vehicles. This shall be accomplished in a manner acceptable to the Police Chief and City Engineer. SECTION 4: Administration and Enforcement. The Building Department shall not approve any building for occupancy until the Planning Director has certified that all the conditions of this ordinance have been satisfied. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adop- tion.
