HomeMy WebLinkAbout1975-10-21; City Council; 5047; CMC 6.02.030-.050 add - Swimming pools health inspectiona 14 21 22 23 24 25 26 27 28 ORDINANCE NO. 5047 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 6, CHAPTER 6.02, OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTIONS 6.02.030, 6.02.040 AND 6.02.050 TO PROVIDE FOR A HEALTH INSPECTION OF SWIMMING POOLS. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: Title 6, Chapter 6.02, of the Carlsbad Municipal Code is amended by the addition of Sections 6.02.030, 6.02.040 and 6.02.050 to read as follows: "6.02.030 Swimming Pool Permit Required. No person shall maintain or operate any pool except a private pool unless an annual operating permit is issued therefor by the Health Officer. A permit issued pursuant to Section 6.02.030 shall expire on the 31st day of December of the year for which it is issued and each such permit shall be renewed annually. Appli- cation for the renewal shall be made to the Health Officer, At the time application is made there shall be paid to the Health Officer the annual fee prescribed by Section 6.02.030, which annual fee is due and payable January 1st of each year. The annual fee, if unpaid, is delinquent January 31st at 5:OO p.m. following the date it is due and thereafter a penalty shall be imposed in the manner prescribed in Section 6,02.030. 6.02.050 Permit Not Transferable. A permit is not transferable from one person or one place to another, and shall be deemed voided if removed from the-place or Location specified in the written application and in the permit. ’’ EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the Adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the 7th day of October , 1975, and thereafter PASSED AND ADOPTED at a regular meeting of said Council held on the 21st day of October , 1975, by the following vote, to wit: AYES : Councilmen Chase, Lewis, and Councilwoman Casler.
