ORDINANCE NO. 9446
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF CARLSBAD, CALIFORNIA,
AMENDING ORDINANCE NO, 9404 TO
REVISE THE CONDITIONS OF APPROVAL
FOR A SPECIFIC PLAN (SP-135) FOR A
190 UNIT CONDOMINIUM PROJECT ON 57
ACRES OF LAND GENERALLY LOCATED AT
THE NORTHEAST CORNER OF THE INTER- SECTION OF LOWDER LANE (SCHUYLER
RANCH ROAD) AND POINSETTIA LANE.
APPLICANT: OCCIDENTAL LAND.
The City Council of the City of Carlsbad, California,
does ordain as follows:
SECTION 1: That Section 3 of Ordinance No. 9404 be
amended as follows:

Delete Condition 2 of Section 3;
Amend Condition No. 10 to read as follows:
"Prior to final building inspection clearance for
each phase, all landscaping and irrigation facil-
ities included in the landscape and sprinkler
plans described in Condition 5 shall be installed.
The applicant shall maintain said landscaping
until such time as a Homeowner'sAssociation is
formed in accordance with the CC&R's for this development ."
Amend Condition No. 12 to read as follows:
"Construction of the project shall be accomplished
in two phases, as shown in Exhibit B, dated
October 9, 1975, on file in the Planning Department
and incorporated by reference herein."
Add Condition No. 13 to read as follows:
"A Homeowner's Association shall be established by the applicant prior to occupancy of any phase of the project. Upon it's establishment said Homeowner's Association shall maintain all landscaping installed in conformance with Con- dition lo."
Add Condition No. 14 to read as follows:
"Prior to the issuance of any building permits the
CC&R's for the project shall be submitted to the

Planning Director for consideration and approval.
Said CC&RPs shall contain language guaranteeing landscape maintenance in accordance with the above conditions, and guaranteeing maintenance of
all private streets and drives."
Add Condition No. 15 to read as follows:
"The location of the dwelling units is not approved
as shown in Exhibit B. Prior to the issuance of building permits for either phase the applicant shall submit site plan exhibits to the Planning
Director for approval with duplex dwellings situate(
as follows:
a. Building height, yards, placement of buildings and lot coverage shall meet the standards of
the R-2 zone classification.
b. Each lot shall have a usable rear yard upon
the pad which has a minimum area of 1200 sq.ft
Should the applicant wish to develop other
than duplex housing he shall be required to
apply for an amendment to this Specific Plan."
EFFECTIVE DATE: This ordinance shall be effective
thirty (30) days after its adoption and the City Clerk shall
certify to the adoption of this ordinance and cause it to be
published at least once in the Carlsbad Journal within fifteen (15
days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 2nd day of December
and thereafter
PASSED AND ADOPTED at a regular meeting of said Council
held on the 16th day of December ,1975, by the following
vote, to wit:
