HomeMy WebLinkAbout1976-01-20; City Council; 9449; San Diego Pipeline booster pump station SP1 2 3 4 5 6 7 a 9 10 11 12 13 0 14 d 20 E - u 21 22 23 24 25 26 27 28 29 ORDINANCE NO. 9449 AN RDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA ADOPTING A SPECIFIC PLAN (SP-167) FOR A PIPELINE BOOSTER PUMP STATION ON PROPERTY GENERALLY LOCATED ON THE NORTHEAST CORNER OF THE INTERSECTION OF EL CAMINO REAL AND OLIVENHAIN ROAD. APPLICANT: SAN DIEGO PIPELINE (. The City Council of the City of Carlsbad, California, doe: ordain as follows: SECTION 1: A Specific Plan (SP-167) is hereby adopted for development of a pipeline booster pump station on property generally located on the northeast corner of the intersection of El Camino Real and Olivenhain Road, more particularly described as : That portion of Lot 8, in section 2, township 13 south, range 4 west San Bernardino meridian, in the County of San Diego, State of California, according to official plat thereof, lying westerly of the westerly line of the Rancho Encinitas and lying easterly of the easterly line of the 90 foot strip of land described in parcel 67083-A in said deed to the County of San Diego, recorded November 28, 1969, as document No.217326 of official records and lying northerly of the northerly line of that certain 60 foot strip described in parcel 61294-B in deed to the County of San Diego recorded September 28, 1961, as document No.169289 of official records known as road survey No. 1631, said plan to consist of a plot plan marked Exhibit A, dated March 14, 1975, and an application with attachments on file in the office of the City Planning Department and incorporated by reference herein, subject to all terms and conditions of this ordinance. SECTION 2: Findings. The approval of Specific Plan 1 2 3 4 5 6 7 e s 1c 11 1; 1: 2: 2; 2: 24 2; 2( 2' 2; 2' (SP-167) is justified by the following findings: A. The proposed use will not be detrimental to the ad- joining properties. B. The site is adequate in size and shape to accommodate the proposed use. C. Adequate setbacks, fences, landscaping and other features necessary to adjust the proposed use to existing or permitted future uses in the neighborhood will be provided and maintained. D. The street system serving the proposed use is adequatc to properly handle additional traffic flow. SECTION 3: Development Conditions. The Specific Plan (SP-167) is approved subject to the following conditions and restrictions, and the development of the property, as described in Section 1 hereof, shall be subject to all such conditions and restrictions which are in addition to all requirements, limitatior and restrictions of all municipal ordinances and state and federal laws now in force or which may hereafter be in force: 1. The approval is granted for the land described in the application and any attachments thereto, and as shown on the Plot Plan submitted labeled Exhibit A, dated March 14, 1975, on file in the Planning Department and incorporated by reference herein. The location of all buildings, fences, signs, roadways, parking areas, land- scaping and other facilities or features shall be located substantially as shown on the plot plan labeled Exhibit A, except or unless indicated otherwise herein. 2. All lighting shall be arranged to reflect away from adjoining properties and streets. 3. All outside storage areas shall be screened from adjacent property and streets. 2. 1 9 .o 11 12 4, A detailed landscape and automated irrigation plan shall be submitted to the Parks and Recreation Director and Planning Director for approval prior to issuance of grading permits to protect the eventual development of the residential area, 5. Prior to occupancy or operation of this project, all landscaping and irrigation facilities included in the landscape and irrigation plan’described in the above condition be installed to protect the eventual develop- ment of the residential area, 6. All utilities, including electrical, telephone and cable television, shall be installed underground and/or shall be completely concealed from view. 7. The applicant will provide evidence satisfactory to the Building Director that a maximum of 60 DBA will not be exceeded at the property boundaries during any period of operation. 8. The land shall be subdivided and recorded prior to issuance of building permits. I SECTION 4: Administration and Enforcement. The Building n 14 d 0 20 21 22 23 24 25 26 27 28 Department shall not approve any building for occupancy until the Planning Director has certified that all the conditions of this ordinance have been satisfied. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption.
