Mudge/Pacific Scene, Inc. 138 dwelling units/140 lots SPORDINANCE NO. 9465 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA ADOPTING A SPECIFIC PLAN (SP-175) FOR A SUBDIVISION CONSISTING OF 138 DWELLING UNITS AND 140 LOTS ON PROPERTY GENERALLY LOCATED WEST OF PASEO DEL NORTE, NORTH OF CAMINO DE LAS ONDAS, EAST OF CAMINITO DEL PRADO AND SOUTH OF CAMINITO ESTRADA. APPLICANT: ITES MUDGE (AGENT: PACIFIC SCENE, INC.). The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: A Specific Plan (SP-175) is hereby adopted for development of a subdivision consisting of 138 dwelling units and 140 lots generally located west of Paseo Del Norte, riorth of Camino De Las Ondas, east of Caminito Del Prado and south of Caminito Estrada, more particularly described on map marked SP-175, Exhibit "A", attached hereto and made a part hereof; and said plan to consist of a plot plan marked Exhibit rrC", dated May 3, 1976, and an application with attachments on file in the office of the City Planning Department and incorporated by reference herein, subject to all terms and conditions of this ordinance. SECTION 2: Findings. The approval of Specific Plan (SP-175) is justified by the following findings: 1. The proposed Specific Plan is consistent with the General Plan because: a) The Land Use Plan Map of the General Plan shows the subject property as RM 4-10 dwelling units per acre. The proposed project has a density of 7.4 dwelling units per acre. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 nn b) Circulation is provided for in a manner consistent with the Circulation Element. 2. The proposed Specific Plan and Master Plan Amendment are consistent with the City of Carlsbad Environmental Protection Ordinance of 1972 because: a) Non-significant environmental impact has been deter- mined for the following reasons: 1) The project is a final phase of an established residential development. Less grading will occur than in previously approved phases, and major street systems are existing. 3. The proposed Specific Plan conforms to applicable City policies and ordinances dealing with public facilities because: a) The provision of public facilities has been assured, meeting City standards concurrent with need, as conditions of approval of this project and prior project approvals on the site. SECTION 3: Development Conditions, The Specific Plan (SP-175) is approved subject to the following conditions and restrictions, and the development of the property, as described in Section 1 hereof, shall be subject to all such conditions and restrictions which are in addition to all requirements, limita- tions and restrictions of all municipal ordinances and state and federal laws now in force or which may hereafter be in force: 1. 2. The approval is granted for the land described in the application and attachments thereto, and as shown on the plot plan submitted labeled Exhibit "C", dated May 3, 1976. The location of all lots, roadways and other facilities and features shall be located sub- stantially as shown on the plot plan labeled Exhibit "C", except or unless indicated otherwise herein. The applicant shall submit a landscape, temporary irrigation and permanent irrigation plan to the Parks and Recreation Director for review and approval 2. 1 2 3 4 5 6 7 8 9 lo 11 12 13 2c 21 22 2: 24 2f 2E 27 2E k 0 3. 4. 5. 6. 7. simultaneously with submission of a grading permit request to the Engineering Department. plan will not be approved until the landscape and irrigation plans are approved by the Parks and Recreation Director. The landscape and irrigation plans will adhere to the following format: The grading a) Detailed permanent landscape plan; The approved permanent landscaping shall be installed within 45 days of the final completed grading. b) Temporary irrigation system: The approved temporary irrigation system shall be provided for all land- scaping under "a" above within 45 days of the final completed grading. c) Permanent irrigation system: The approved permanent irrigation system shall be installed for all land- scaping under "a" above prior to occupancy permit issuance for any of the units. Ornamental street lighting shall be provided for as required by Municipal Ordinance. The developer shall deposit cash in the amount necessary to energize said street lights for an eighteen-month period after con- struction, to permit the incorporation of the subdivision into a maintenance district. All public improvements shall be made in conformity with the City of Carlsbad's standards, the Subdivision Ordinance and other City standards, to the satisfaction of the City Engineer, without cost to the City of Carlsbad and free of all liens and encumbrances. Improvement plans for water system shall meet the require ments of that service district. Applicant shall dedicate and improve "A" Street to the City of Carlsbad's standards on the basis of a 54-foot street section with a 34-foot curb-to-curb dimension according to its alignment on the tentative map. Prior to recordation of the final map, the applicant or his successor in interest shall enter into a secured agreement guaranteeing payment of me-fourth of the cost of a future traffic signal at the intersection of Paseo del Norte and Camino de las Ondas prior to recordation of the final map. The Building Department shall not approve any building for occupancy until the Planning Director has certified that all the conditions of this ordinance have been satisfied. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad June , 1976, City Council held on the 15th day of and thereafter PASSED AND ADOPTED at a regular meeting of said Council held on the 6th day of July , 1976, by the following vote, to wit: shall have a change of paving at all intersections with public streets to delineate street type boundary. 8. CC&R's for this development shall be submitted to the Planning Director for review and approval prior to the final building inspection clearance for any phase.
