SPORDINANCE NO. 9474 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING AN AMENDED SPECIFIC PLAN (SP-20 (A) )TO ALLOW DEVELOPMENT OF FORTY APARTMENTS IN FIVE BUILDINGS ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF TAMARACK AVENUE BETWEEN JEFFERSON STREET AND HIBISCUS CIRCLE. APPLICANT: NORMAN STARR. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION I: An amended Specific Plan (SP-20(A)) is hereby adopted for the development of forty apartments in five buildings on property generally located on the north side of Tamarack Avenue between Jefferson Street and Hibiscus Circle, more particularly described on map marked SP 20 (A) , Exhibit "A", attached hereto and made a part hereof, and said plan to consist of a plot plan marked Exhibit "C", dated October 26, 1976, and an application with attachments on file in the office of the City Planning Department and incorporated by reference herein, subject to all terms and conditions of this ordinance. SECTION 2: That the findings of the Planning Commission, contained in Resolution No. 1295, constitute the findings of the City Council. Said resolution is on file in.the Planning Depart- ment and is incorporated by reference herein. SECTION 3: Development Conditions. The amended Specific Plan (SP-20(A)) is approved subject to the following conditions and restrictions, and the development of the property as described in Section 1 hereof, shall be subject to all such conditions and restrictions which are in addition to all requirements, limitations and restrictions of all municipal ordinances and state and federal 1 2 3 4 5 6 7 8 9 10 11 19 20 21 22 23 24 25 26 27 28 laws now in force or which may hereafter be in force: 1. 2. 3. 4. 5. 6. 7. 8. 9. The approval is granted for the land described in the application and attachments thereto, and as shown on the plot plan submitted labeled Exhibit "C", dated October 26, 1976. The location of all lots, roadways and other features shall be located substantially as shown on the plot plan labeled Exhibit "C", except or unless indicated otherwise herein. In the event that the currently anticipated thirty-four feet of dedication on Tamarack Avenue is not required at the time of building permit issuance, and the required dedication is not over ten feet, the approval herein will apply to the plot plan labeled Exhibit "D", dated October 26, 1976. Minor changes may be approved by the Planning Director to accommodate approved dedication that may affect this plan. Exhibits "C" and "D", dated October 26, 1976, may be modified as to building location, parking lot design and surfacing as shown on the Plot Plan, labeled Exhibit "E", dated December 7, 1976. The applicant shall submit a permanent landscape and irrigation plan to the Park and Recreation Director prior to issuance of building permits. In order to provide for reasonable fire protection dur- ing the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department prior to combustible materials on site. The applicant shall process an adjustment plat to consolidate the two lots within the specific plan boundary. One of the conditions of approval of the adjustment plat will be that the owner offer to dedicate thirty-four feet along the Tamarack Avenue frontage, including a twenty foot radius segment at the inter- section of Tamarack and Jefferson, and execute a lien contract agreement for future improvement of Tamarack Avenue on the basisof half street section. If on-site public fire hydrants are required by the Fire Marshal, they shall be served by public waterline extensions approved by the City Engineer, and twelve foot waterline easements shall be dedicated. The existing school walkway, or an acceptable paved alternate walkway, shall be maintained during construction. A six foot high masonry wall shall be constructed along the north and west boundaries of the property prior to the issuance of occupancy permits. SECTION 4: Administration and Enforcement. The Building lepartment shall not approve any building for occupancy until the ?lanning Director has certified that all the conditions of this Drdinance have been satisfied. SECTION 5: Specific Plan (SP-20(A)) as adopted by City Zouncil Ordinance No. 9302 is repealed. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the 2lslday of December I 1976, and thereafter PASSED AND ADOPTED at a regular meeting of said Council held on the 4th day of January , 1977, by the following vote, to wit: AYES : NOES : Councilman Packard Councilmen Frazee, Lewis, Skotnicki and Counci 1 woman Cas1 er ABSENT: None ROBERT C.
